HomeMy WebLinkAbout22 075 Lawson Street Closure and Sale of Land Agreement By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2022 - 075 A BY-LAW TO STOP UP AND CLOSE PART OF LAWSON LANE MORE PARTICULARLY IDENTIFIED AS PT 1 ON 3R-10563; KINCARDINE BEING PART OF PIN 33300-0070 AND TO AUTHORIZE THE SALE OF THE SAID LANDS TO THE ABUTTING LANDOWNER WHEREAS pursuant to the said Municipal Act, 2001, S.O, 2001, c.25, Section 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the ghts, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS Subsection 27(1) of the Municipal Act, 2001, provides that a municipality may pass by-laws in respect of a highway over which it has jurisdiction; AND WHEREAS The Corporation of the Municipality of Kincardine is the registered owner of certain lands known as 4979 Highway 9, Kincardine, legally described as LAWSON LANE PL 26 PT 1 3R-10563; KINCARDINE; being Part of PIN 33300- AND WHEREAS the Council of The Corporation of the Municipality of Kincardine has been approached and is desirous of divesting itself of the Subject Lands under certain terms and conditions to the abutting landowners, being Christopher Ernest Buhrow and James Dee Buhrow, who are the registered owners of lands bearing PIN 33300- AND WHEREAS it is recommended that the road allowance described as Part 1 on Reference Plan deposited in the Land Registry Office of Bruce County (No.3) as 3R-10563 be stopped up and closed as a public highway and be sold on certain terms and conditions, as adopted by Council at its meeting held on July 12, 2021; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine #07/12/21 15 dated July 12, 2021 and directed that public notice be given of -Law to stop up and close the portion of road described as Part 1 on 3R-10563; Kincardine; AND WHEREAS public notice of the intention to pass this By-Law was posted on the Municipal website on April 4, 2022. AND WHEREAS the Municipality of Kincardine has complied with By-Law No. 2008-141; Page 2 Lawson Street Closure and Sale of Land Agreement By-law By-law No. 2022 - 075 NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the lands legally described as PART OF LAWSON LANE PL 26 PT 1 3R-10563; KINCARDINE; being part of PIN 33300 0070 (LT) are hereby stopped up and closed as a public highway. 2. That The Corporation of the Municipality of Kincardine authorizes the conveyance of PART OF LAWSON LANE PL 26 PT 1 3R-10563; KINCARDINE; being part of PIN 33300 0070 (LT) to Christopher Ernest Buhrow and James Dee Buhrow for the sum of $7,432.04 plus HST. 3. That the Mayor and CAO are hereby authorized and directed to execute, on behalf of The Corporation of the Municipality of Kincardine, all deeds, undertakings, agreements and other documents as may be required to complete the sale of the said lands and affix the corporate seal as and when required. 4. This by-law shall come into full force and effect upon its final passage 5.
