HomeMy WebLinkAbout22 027 Lot 82 & 83 Victoria W/S Deeming By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT ,•` .lf 49�,�,d'lpgCITY Of BY-LAW No. 2022 - 027 BEING A BY-LAW DEEMING LOT 82 AND LOT 83 WEST SIDE VICTORIA STREET PLAN KINCARDINE; MUNICIPALITY OF KINCARDINE AND FURTHER DESCRIBED IN SCHEDULE "A" TO THIS BY-LAW, NOT TO BE A LOT ON A REGISTERED PLAN OF SUBDIVISION WHEREAS Section 50 (4) of the Planning Act, R.S.O. 1990, Chapter P.13 ("Planning Act") authorizes the Council of a Municipality to pass a by-law to designate any registered Plan of Subdivision or part thereof that has been registered for eight years or more, to be deemed not to be a registered Plan of Subdivision for the purposes of Section 50 (3) of said Planning Act; AND WHEREAS Richard Eric Fohkens and Donna Elaine Fohkens are the registered owners of Lot 82 and Lot 83 West Side Victoria Street, Plan Kincardine; Municipality of Kincardine; AND WHEREAS it is deemed expedient in order to properly develop this land that a by-law be passed deeming these lots not to be lots on a registered plan of subdivision; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That Lots 82 & 83 West Side Victoria Street Plan Kincardine; Municipality of Kincardine, legally described in Schedule "A", are deemed not to be lots on a registered plan of subdivision. 2. That the Clerk of the Municipality of Kincardine is instructed to cause a certified copy of this by-law to be lodged with the County of Bruce, Planning Department and registered in the Bruce County Land Registry Office (LRO #3), as required by Sections 50 (26) and (28) of the Planning Act. 3. That the Clerk shall give notice to the owners of the said lot as required by Section 50 (29) of the Planning Act. 4. That this By-law shall come into full force and take effect on the date it is passed by the Council of The Corporation of the Municipality of Kincardine, subject to the provisions of subsection 50 (27) of the Planning Act. 5. That this By-law may be cited as the "Lot 82 & 83 Victoria W/S Deeming By- law".
