A BY-LAW TO AMEND ZONING BY-LAW NO. 2003 – 25,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR
THE MUNICIPALITY OF KINCARDINE
West Ridge on the Lake Inc.
Lots 1-41 and Blocks 47, 48, 49 and 50 Plan 3M-259
Municipality of Kincardine
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes
the Councils of Municipalities to enact and amend zoning by-laws which comply
with an approved official plan;
AND WHEREAS Council passed By-law No. 2016 – 028 on March 3, 2016, which
included a Holding (H) Provision on certain lands;
AND WHEREAS Council passed By-law No. 2020 – 111 on August 10, 2020 to
enter into a Subdivision Agreement with West Ridge on the Lake Inc (WROTL) on
the lands knows as Part of Lots 21-24 Con.A, Municipality of Kincardine;
AND WHEREAS the holding provisions in By-law 2003 – 25 have been satisfied
for phase one of this Plan of Subdivision;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
has enacted By-law 2003- 25, a zoning by-law enacted under Section 34 of the
said Planning Act;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
desires to amend By-law 2003-25;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further
amended by changing thereon from ‘EP-t-H’ to ‘EP-t’ the zoning
designation of those lands described as Block 50 3M-259; Municipality of
Kincardine, as outlined on the attached Schedule ’A’ being Phase 1
2. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further
amended by changing thereon from ‘R1-bh-H’ to ‘R1-bh’ the zoning
designation of those lands described as Lots 1-17 and 41 3M-259;
Municipality of Kincardine, as outlined on the attached Schedule ‘A’ being
Phase 1
3. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further
amended by changing thereon from ‘R2-f-H’ to ‘R2-f’ the zoning
designation of those lands described as Lots 18-40 3M-259; Municipality of
Kincardine, as outlined on the attached Schedule ’A’ being Phase 1.

4. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further
amended by changing thereon from ‘OS-b-H’ to ‘OS-b’ the zoning
designation of those lands described as Block 48 and Block 49 3M-259;
Municipality of Kincardine, as outlined on the attached Schedule ’A’ being
Phase 1.
5. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further
amended by changing thereon from ‘OS-c-H’ to ‘OS-c’ the zoning
designation of those lands described as Block 47 3M-259; Municipality of
Kincardine, as outlined on the attached Schedule ’A’ being Phase 1.
6. This By-law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, R.S.O.
1990.
7. This By-law may be cited as the “Amendment to Comprehensive Zoning
By-law No. 2003-25, Holding Removal WROTL Phase 1 By-law”.
