HomeMy WebLinkAbout22 014 Transfer of Lands (Wood Estate) By-lawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2022 - 014 BEING A BY-LAW TO AUTHORIZE THE TRANSER OF CERTAIN LANDS TO THE ESTATE OF DORIS MAY WOOD WHEREAS Section 9 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, grants to municipalities the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS The Corporation of the Municipality of Kincardine (“Municipality of Kincardine”) is the owner of certain lands legally described as PCL 1 SEC LP1233; PT 11 PL 1233 DEPOSITED AS R96684A KINCARDINE; KINCARDINE; being all of PIN 33311-0195 (LT); AND WHEREAS the Estate of Doris May Wood (“Wood”) is the registered owner of 928 Saugeen Street; Kincardine; legally described as PCL 37-1 SEC M3; LT 37 PL M3; KINCARDINE; being all of PIN 33311-0174(LT); AND WHEREAS the Municipality of Kincardine and Wood entered into Minutes of Settlement dated August 9, 2021 to resolve Wood’s access issue, which terms are to be kept confidential; AND WHEREAS on January 17, 2022 Council passed a Resolution declaring the land identified as PART 1 on the draft reference plan attached as Schedule “A” hereto, which forms part of Part 11, Plan 1233 Deposited as R93684A, Kincardine; being part of PIN 33311-0195(LT) (“PART 1”), as surplus to the needs of the Municipality of Kincardine and supported the conveyance of PART 1 to the owner of 928 Saugeen Street, Kincardine in accordance with the terms of the Minutes of Settlement; AND WHEREAS the Municipality of Kincardine has complied with By-Law No. 2008-141; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the surplus lands described as part of Part 11, Plan 1233 Deposited as R93684A, Kincardine; being part of PIN 33311-0195(LT), and more particularly identified as PART 1 on the draft reference plan attached and marked as Schedule “A”, and to be more particularly identified for registration purposes by a Reference Plan deposited in the Land Registry Office of Bruce County (No.3), shall be transferred to the Estate of Doris May Wood as owner of 928 Saugeen Street, Kincardine for the sum of $6,000.00 plus HST and in accordance with the Minutes of Settlement. 2. The Chief Administration Officer and the Municipality’s Solicitor are authorized and directed to take all steps necessary to implement the Minutes of Settlement to effect the conveyance contemplated in paragraph 1 herein. That the Mayor and Chief Administrative Officer be authorized to execute the Transfer/Deed of Land as well as any documentation necessary to effect the terms of the Minutes of Settlement and the conveyance of PART 1 as contemplated herein. 4. This by-law shall come into force immediately upon being enacted. 5. This by-law may be cited as the “Transfer of Lands (Wood Estate) By-law”.
