No. 2021 – 191
A BY-LAW TO ADOPT AMENDMENT NUMBER 2 TO THE OFFICIAL PLAN
OF THE MUNICIPALITY OF KINCARDINE
WHEREAS The Corporation of the Municipality of Kincardine is empowered to amend
its Official Plan as required;
AND WHEREAS the process for considering such an Amendment was in accordance
with Sections 17 and 21 of the Planning Act, R.S.O. 1990-c.P.13.;
AND WHEREAS the Amendment to the Official Plan is deemed to be appropriate and
in the public interest;
NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. That Amendment Number 2 to the Municipality of Kincardine 2021 Official Plan
By-law No. 2021 - 006, a copy of which is attached to and forms part of this By-
law, is hereby adopted.
2. That the Clerk is hereby directed to forward the adopted Amendment together
with the necessary supporting documentation to the County of Bruce for final
approval.
3. This By-law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, R.S.O.
1990,c.P.13.
4. This By-law may be cited as the “OPA#2 to the 2021 Official Plan By-law”.

Part B – The Amendment #2
Introductory Statement
All of this part of the document entitled "Part B – The Amendment" and consisting of the
following text and attached map designated as Schedule ‘A’ constitutes Amendment
Number 2 to the 2021 Official Plan By-law No. 2021 - 006.
DETAILS OF THE AMENDMENT
The Municipality of Kincardine 2021 Official Plan By-law No. 2021 - 006 is proposed to
be amended as follows:
(1) “Schedule A: Land Use Plan” to the Municipality of Kincardine 2021 Official Plan
By-law No. 2021 - 006 is hereby amended by adding the special policy number
OPA #2 on lands described as INVERHURON PARK N PT LOT 3 (Bruce Twp),
Municipality of Kincardine as outlined in the attached Schedule ‘A’.
(2) The Municipality of Kincardine 2021 Official Plan By-law No. 2021 - 006 is
amended by adding the following subsection to Section D8 Shoreline
Development:
"D8.5.2.7 – AREA SPECIFIC POLICIES – Shoreline Residential Uses
Woods (L-2021-011)
Notwithstanding the policies of Section G2.4 [Land Division Policies] of this Plan,
on the lands described as INVERHURON PARK N PT LOT 3 (Bruce Twp),
Municipality of Kincardine, and identified as OPA #2, a lot may be created by
infilling where the infill lot is between two existing dwellings and the dwellings are
more than 100 metres apart."
