HomeMy WebLinkAboutKIN 85 4630 Construct serv cen THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4630 BEING A BY-LAW TO AUTHORIZE THE CONSTRUCTION OF A NEW SERVICE CENTRE. . WHEREAS pursuant to paragraph 51 of Section 210 of the Municipal Act, By-laws may be passed by the Councils of local municipal- ities for authorizing the work hereinafter setforth¡ AND WHEREAS the Public Utilities Commission is the owner of lots 33 and 34 on the east side of Queen Street, Town of Kincardine¡ AND WHEREAS the Council of the Corporation of the Town of Kincardine by an affirmative vote of at least three-fourths of all members of Council ENACTS as follows: 1. In this By-law "work" shall mean the construction of a concrete block service centre having an area of approximately 700 square metres at an estimated cost of $420,000.00. 2. The undertaking of the said work, the extension of the powers of The Corporation of the Town to proceed therewith, and the provision of monies therefor by the issue of debentures in an amount not exceeding $420,000.00 less payment of $120,000.00 from the Hydro Reserve fund and repayable in 20 years is hereby approved and authorized. 3. The Treasurer of the said Corporation may, subject to approval of Council, agree with any bank or person for temporary advances of money to meet the costs of the work pending the completion thereof. 4. B;M.uRoss& _Associates' Limited be appointed as Engineer and -they _ do furtherwith make such plans, profiles and specifications and furnish such information as may be necessary for the making of a contract for the execution of the work. 5. The work shall be carried on and executed under the superv~s~on of and according to the directions and orders of the Engineer. 6. In each year in which an instalment of the said debentures becomes due, the amount to be paid shall be paid from the income of the P.U.C. until the debenture has been paid in full. 7. This By-law shall not come into force and effect until the approval of the Ontario Municipal Board has been obtained pursuant to Section 64 of the Ontario Municipal Board Act and shall come into force and effect upon such approval being given.
