TIlE CORPORATION OF TIlE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2002-118
BEING A BY-LAW TO AUTHORIZE THE MAINTENANCE OF PARTS
OF THE SWICK MUNICIPAL DRAIN IN THE MUNICIPALITY OF
KINCARDINE, FORMERLY THE TOWNSHIP OF BRUCE, AND THE
PAYMENT THEREFORE BY THE LANDS AND ROADS AFFECTED.
WHEREAS the Council of the Municipality of Kincardine has received a request
for the maintenance of part of the Main Drain and part of Branch A of the Swick
Municipal Drain, as are more particularly delineated in red on the plan attached
hereto as Schedule A;
AND WHEREAS Branch A of this Municipal Drain was constructed after a report
prepared by W.G. McGeorge OLS. C.E. dated September 21, 1954 and
adopted by By-law No. 716 of the Township of Bruce, and whereas the Main
Drain portion of this Municipal Drain was constructed after a report prepared by
W.J. Mannerow, P.Eng. dated February 22, 1973 and adopted by By-law No.
1094 of the Township of Bruce, these being the current By-laws pertaining to this
Drain;
AND WHEREAS the Council of the Municipality of Kincardine now desires to
proceed with the maintenance of part of Branch A and part of the Main Drain
portion of this Drain without obtaining the Report of an Engineer, in accordance
with Sections 74 and 75 of the Drainage Act;
AND WHEREAS in accordance with Section 74 of The Act, the cost of the
maintenance of municipal drains is to be at the expense of all the upstream lands
and roads in any way assessed for the construction or improvement of the
drainage works and in the proportion determined by the current By-law pertaining
thereto;
AND WHEREAS the estimated cost of this maintenance is $2500 for Branch A
and $2500 for the Main Drain (two thousand five hundred dollars for each
portion);
AND WHEREAS $5000 is the amount to be contributed by the lands and roads
in the Municipality of Kincardine for the maintenance of this municipal drain;
AND WHEREAS the Council of the said Municipality is of the opinion that the
maintenance of this municipal drain is desirable;

NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine, pursuant to the provisions of The Drainage Act ENACTS as follows:
1. That the following repairs are hereby authorized and shall be completed in
accordance herewith;
a) Branch A - open drain clean out and spreading of spoil through Lots 1
and 2, Concession 11; and
b) Main Drain - open drain clean out and spreading of spoil through Lots J
and 1, Concession 12 and through part of Lot 1, Concession 11 to the
confluence with Branch A;
2.
That the amount of $5000 necessary to be raised by the Municipality of
Kincardine for such drainage works shall be made a cash assessment
upon the lands and roads affected by the said Municipal Drain, in
accordance with the two assessment schedules attached hereto as
Schedules Band C, and shall be due within 30 days of the date of the
original invoice, after which time in accordance with Section 61,
Subsection (4), the assessments and rates imposed under The Act shall
be deemed to be taxes, and the provisions of the Municipal Act as to
collection and recovery of taxes, and the proceedings that may be taken in
default of payment thereof, apply; and
3. This by-law shall come into full force and effect upon its final passing.
4. This by-law may be cited as the ·Swick Municipal Drain Maintenance
By-Law· .
