HomeMy WebLinkAbout04 036 road closure opg bask e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2004 - 36 BEING A BY-LAW TO TEMPORARILY CLOSE STREETS T FACILITATE AN OPG YOUTH BASKETBALL LEAGUE TOURNA ENT WHEREAS Section 42 of the Municipal Act, 2001, S.O. 2001, . 25, as amended, authorizes Councils of municipalities to close on a temporary basis any highway under the jurisdiction of the municipality for any purpose specified in the b -law; AND WHEREAS the Kincardine OPG Youth Basketball League has requested that River Lane be closed to facilitate a year end basketball toumamen on Saturday, June 12,2004; NOW THEREFORE the Council for The Municipality of Kincardine NACTS as follows: 1. That part of River Lane, from South Street to Durham Str et, be closed to all vehicular traffic on Saturday, June 12, 2004 from 8:00 a.m. to 4:00 p.m. for the purpose of holding the Kincardine OPG Youth Basketbal League Year End Tournament. The Kincardine OPG Youth Basketball League shall erect t each end of such highway or portion thereof, and where an alternative route eviates therefore, a barricade upon which an adequate warning device shall be xposed and in good working order continuously and at such points there shall e erected a detour sign indicating the alternative route and containing a notic that the highway is closed to traffic. 2. Every person who uses a highway or portion of a highwa so closed to traffic does so at his or her own risk and The Municipality of Kinca dine is not liable for any damage sustained by a person using the highway 0 portion thereof so closed to traffic. 3. 4. Every person who without lawful authority uses a highway r portion thereof so closed to traffic while it is protected in accordance with thi paragraph, or who removes or defaces any barricade, device, detour sign or n tice placed thereon by lawful authority, is guilty of an offence and is subject to the penalties as set forth in the Provincial Offences Act and is also liable to The Municipality of Kincardine for any damage or injury occasioned by such w ngful use, removal or defacement. . . ./2 -- e e e OPG Youth Basketball Tournament Road Closing By-Lav.j 2004 By-law No. 2004 - 36 Page 2 This by law shall come into full force and effect upon its final p~ssage. This by-law may be cited as the "OPG Youth Basketball ~ournament Road Closing By-law, 2004", 5. 6.
