BEING A BY·LAW TO ACCEPT A TENDER FOR THE SUPPL OF SCREENED WINTER SAND FOR MUNICIPAL ROADS (Bannerman Contracting) WHEREAS Section 44 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality that has jurisdiction over a highw y or bridge shall keep it in a state of repair that is reasonable in the circumstance ; AND WHEREAS the Council for the Municipality of Kincardine cknowledges the need for sanding the Municipality's roadways during the winter onths; AND WHEREAS the Council for the Municipality of Kincardine d ems it expedient to accept a tender to supply 4,000 tonne of screened wi ter sand for the Municipality's roadways including the use of an elevator to I ad sand into the municipality's sand sheds; NOW THEREFORE the Council for The Corporation of th Municipality of Kincardine ENACTS as follows: 1. That the tender of Bannerman Contracting Ltd. in the amount of $14,260.00, including all applicable taxes, be hereby acc pted. That the Mayor and CAO be hereby authorized to sign on behalf of the Council for the Municipality of Kincardine any con racts and other documents required to authorize such work to commence 2. 3. This by-law shall come into full force and effect upon its fi al passage. 4. This by-law may be cited as the "Winter Sand 2004 (B nnerman) Tender Acceptance By-law".
