HomeMy WebLinkAbout21 177 Comprehensive Zoning By-law Review (MHBC) Proposal Acceptance By-lawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2021 – 177 BEING A BY-LAW TO ACCEPT A PROPOSAL FOR THE COMPREHENSIVE ZONING BY-LAW REVIEW (Macnaughton Hemson Britton Clarkson Planning Limited [MHBC]) WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, as amended, Section 8 (1) and 9 provides that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality’s ability to respond to municipal issues and a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS on April 12, 2021 Council passed Resolution #04/12/21-04 to exempt the acquisition of consulting services for the zoning by-law review from Section 16 of the Purchasing and Procurement Policy GG.2.17 to allow for the extension of the existing contract with Macnaughton Hemson Britton Clarkson Planning Limited (MHBC), who completed the Official Plan Review; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it necessary to accept a proposal for a consultant to conduct a Comprehensive Zoning By-law review as per Report Planning-2021-09; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the proposal of Macnaughton Hemson Britton Clarkson Planning Limited (MHBC) to conduct a Comprehensive Zoning By-law Review in the amount of $119,778.13 plus HST be hereby accepted. 2. That the Mayor and Chief Administrative Officer be authorized and directed to execute, on behalf of The Corporation of the Municipality of Kincardine, any contracts and other documents required to authorize such work to commence. 3. This by-law shall come into full force and effect upon its final passage. 4. This by-law may be cited as the “Comprehensive Zoning By-law Review (MHBC) Proposal Acceptance By-law”. READ a FIRST and SECOND TIME this 8th day of November, 2021. READ a THIRD TIME and FINALLY PASSED this 8th day of November, 2021. Mayor Clerk
