HomeMy WebLinkAbout21 171 Municipality of Kincardine Council Composition By-lawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2021 - 171 BEING A BY-LAW TO PROVIDE FOR THE COMPOSITION OF COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE AND TO REPEAL BY-LAW NO. 2005 - 140 WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Section 217, provides that a municipality may divide or redivide the municipality into wards or dissolve the existing wards, and change the composition of its Council; AND WHEREAS an order made under made under the authority of the former Municipal Act, R.S.O. 1990, c. M.45 by the Minister of Municipal Affairs and Housing and dated January 30, 1998 gave effect to a restructuring proposal affecting the 27 municipalities located within the County of Bruce; AND WHEREAS pursuant to the said Minister’s Restructuring Order, Wards – Section 10, the former Township of Kincardine-Bruce-Tiverton was divided into three (3) wards; AND WHEREAS Bill Pr15, An Act to Change the Name of The Corporation of the Township of Kincardine-Bruce-Tiverton to The Corporation of the Municipality of Kincardine received Royal Assent on December 23, 1999; AND WHEREAS the Municipality of Kincardine’s Council current composition are set out in By-law No. 2005-140 passed by Council on September 2, 2005 and amended by the Order of the Ontario Municipal Board issued December 20, 2005 as Order No. 3326, “ AND WHEREAS Council Resolution #01/18/21 – 04 was passed on January 18, 2021 directing Staff to receive public input on various options for electing the Deputy Mayor starting in the 2022 Municipal Election; AND WHEREAS a Public Meeting was held on August 9, 2021 and a public survey was conducted from July 21, 2021 to September 30, 2021; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it desirable to amend the composition of Council per Report Clerk 2021-33 Election Process for the Deputy Mayor and that the new composition take effect for the 2022 Municipal Elections; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the composition of the Council of the Corporation of The Municipality of Kincardine as permitted by and in accordance with the Municipal Act, 2001, S.O. 2001, c. 25, Section 217 (1) shall be: (a) A mayor elected at-large; (b) A deputy mayor elected at-large; (c) Three (3) councillors elected at-large; Page 2 of 2 Municipality of Kincardine Council Composition By-law By-law No. 2021 - 171 (d) Four (4) councillors elected using a ward system from the three wards as they exist at the time of passage of this by-law, with two (2) councillors being elected from Ward 1 and one each from Ward 2 and Ward 3. 2. In this by-law: (a) “at-large” means an electoral system in which all eligible voters in the Municipality’s boundaries vote on the same list of candidates; and (b) “ward system” means an electoral system in which the Municipality is divided into smaller areas (wards) and voters living in each ward votes on a list of candidates seeking to represent that ward. 3. That By-law No. 2005-140 is hereby repealed. 4. That pursuant to the Municipal Act, 2001, S.O. 2001, c. 25, Section 217(3), the 2022 Municipal Election, and all subsequent elections and/or by- elections shall be conducted pursuant to the provisions of this by-law. 5. This by-law may be cited as the “Municipality of Kincardine Council Composition By-law”. READ a FIRST and SECOND TIME this 1st day of November, 2021. READ a THIRD TIME and FINALLY PASSED this 1st day of November, 2021. Mayor Clerk
