THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2005 - 033
BEING A BY -LAW TO ACCEPT A QUOTE TO CONSTRUCT AN ADDITION
AND TO INSTALL AN ELEVATOR AT THE KINCARDINE CENTRE FOR THE
ARTS, 707 QUEEN ST.
MUNICIPALITY OF KINCARDINE
(509989 Onto Inc. - Will's Contracting)
WHEREAS the Municipal Act, 2001, 5.0. 2001, c. 25 Section 11 (2) authorizes
municipalities to pass by-laws respecting matters within the sphere of jurisdiction
of culture, parks, recreation and heritage;
AND WHEREAS pursuant to the said Municipal Act, Sections 8 and 9 (1) provide
municipalities with the powers of a natural person to enable them to govern their
affairs as they consider appropriate under this or any other Act and to enhance
their ability to respond to municipal issues;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
by its adoption of Resolution #2004 - 110 supports the installation of an elevator
at the Municipal Arts Facility located at 707 Queen Street in the Municipality of
Kincardine;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
adopted By-law No. 2004 - 111 to authorize the purchase of an elevator from
Davidson - Hill Elevator Inc. for the Kincardine Arts Centre;
AND WHEREAS Council deems it expedient to accept a quote from 509989
Ontario Inc. (Will's Contracting) for the construction of an addition and the
installation of the elevator at the Kincardine Arts Centre in the amount of
$128,500.00 excluding taxes and to add a contingency allowance;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the quote of 509989 Ontario Inc. in the amount of $128,500.00,
excluding taxes, and as outlined in Schedule "Aft attached to this by-law, be
hereby accepted .
2. That a contingency allowance, not to exceed 10% of the contract amount,
be hereby authorized.
3.
That the Mayor and CAO be hereby authorized to sign, on behalf of the
Council for The Corporation of the Municipality of Kincardine any contracts
and other documents required to authorize the installation of the elevator.

4. This by-law shall come into full force and effect upon its final passage.
5. This by-law may be cited as the "Kincardine Arts Centre Elevator
Installation (509889 Ontario Inc.) Acceptance, By-Jaw".

16th day of March, 2005.
