NO. 2021 - 109
A BY-LAW TO ESTABLISH PART 2 ON PLAN 3R-10042 AS PART OF THE
PUBLIC HIGHWAY SYSTEM FOR
THE MUNICIPALITY OF KINCARDINE
WHEREAS the Municipal Act, 2001, S.O. 2001, c.25 authorizes a municipality to
pass by-laws regarding highways;
AND WHEREAS The Corporation of the Municipality of Kincardine is the owner of
the lands described in this By-law;
AND WHEREAS it is deemed appropriate to establish and assume the lands
described in this By-law as public highway for public use;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the lands described as PART LOT 16 CONCESSION A KINCARDINE
DESIGNATED AS PART 2 ON 3R-10042; MUNICIPALITY OF
KINCARDINE; being part of PIN 33303-0875 (LT) are hereby established as
a public highway under the jurisdiction of The Corporation of the Municipality
of Kincardine and shall form part of the public highway known as "Gary
Street".
2. This by-law shall come into full force and have immediate effect upon final
passage thereof.
3. This by-law may be cited as the "Road Establishment (Gary Street) By-law".
READ a FIRST and SECOND TIME this 14t" day of June, 2021.
READ a THIRD TIME and FINALLY PASSED this 14t" day of June, 2021.

Explanation for nominal considerations:
s) other: Part 2 on Plan 3R-10042 is a highway as defined in the Municipal Act, 2001. This is a transfer from the Transferee, The
Corporation of the Municipality of Kincardine to itself for the purposes of splitting the within PIN to sever the said highway from the
remaining lands that do not constitute a highway but are contained within the said PIN.

6. Other remarks and explanations, if necessary.
1. The information prescribed for purposes of section 5.0.1 of the Land Transfer Tax Act is not required to be provided for this
conveyance.
2. The transferee(s) has read and considered the definitions of "designated land", "foreign corporation", "foreign entity", "foreign
national', "specified region" and "taxable trustee" as set out in subsection 1(1) of the Land Transfer Tax Act. The transferee(s)
declare that this conveyance is not subject to additional tax as set out in subsection 2(2.1) of the Act because:

4. The transferee(s) declare that they will keep at their place of residence in Ontario (or at their principal place of business in
