THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2021 - 082
BEING A BY-LAW TO AUTHORIZETHE SIGNING OF ASTAFF SHARING
AGREEMENT WITH THE CORPORATION OF THE TOWN OF SAUGEEN
SHORES
WHEREAS Sections 8 (1) and 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provide that the powers of a municipality under this or any other Act
shall be interpreted broadly so as to confer broad authority on the municipality to
enable the municipality to govern its affairs as it considers appropriate and to

capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under this or any other Act;
AND WHEREAS Section 3 (2) of the Building Code Act, R. S. O. 1992 Chapter
23 provides that the Council of each municipality shall appoint a Chief Building
Official and such inspectors as are necessary for the purposes of the
enforcement of the Building Code Act;
AND WHEREAS the Corporation of the Municipality of Kincardine is in need of
building inspection service on an intermittent basis to cover a temporary vacancy
for its Building Department;
AND WHEREAS The Corporation of the Town of Saugeen Shores is prepared to
assist during this period by providing a properly qualified and trained building
department staff person;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it necessary enter into a Staff Sharing Agreement withThe Corporation of
the Town of Saugeen Shores
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That The Corporation of the Municipality of Kincardine enter into a Staff
Sharing Agreement with The Corporation of the Town of Saugeen Shores.
2. That Josh Planz be appointed as Acting Chief Building Official for The
Corporation of the Municipality of Kincardine for the term of the attached
agreement.
3. That Jaime Bell be appointed as Acting Building Inspector for the Municipality
of Kincardine for the term of the attached agreement.
4. That the Mayor and CAO be authorized and directed toexecute, on behalf of
The Corporation of the Municipality of Kincardine, the Staff Sharing
Agreement with The Corporation of the Town of Saugeen Shores, attached
hereto as <@EBAQHB X0Y >nd forming part of this By-law.

5. That all other By-laws inconsistent with this By-law are hereby repealed.
6. That this By-law shall come into full force and effect upon its final passage.
