THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2021 - 045
BEING A BY-LAW TO AUTHORIZE THE USE OF INTERNET AND
TELEPHONE VOTING FOR THE
2022 MUNICIPAL ELECTION
WHEREAS subsection 42.(1) of the Municipal Elections Act, 1996, S.O. 1996,
C32 (the Act) provides that the council of a local municipality may pass a by-law
authorizing electors to use an alternative voting method that does not require
electors to attend at a voting place in order to vote;
AND WHEREAS subsection 42.(2)(a) of the Act sets out that a by-law passed
under subsection 42.(1) applies to a regular election if the by-law is passed on or
before May 1 in the year of the year of the election;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it appropriate to use voting by internet or telephone for the 2022 municipal
election;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the use of the alternative voting method of Internet and Telephone
voting is hereby authorized for the 2022municipal election.
2. That, per section 42 (5) of the Act, the provisions relating to sections 43
(advance votes) and 44 (voting proxies) will not apply in the 2022 municipal
election.
3. This by-law shall come into full force and effect upon its final passage.
