THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2021 - 031
BEING A BY-LAW TO AUTHORIZE THE SIGNING OF AN AGREEMENT TO
SUPPLY REPLACEMENT CROSSWALK CABINETS AND PUSHBUTTONS
FOR CROSSWALKS ON QUEEN STREET (LAMBTON AND HARBOUR
STREETS) IN THE MUNICIPALITY OF KINCARDINE
(Econolite Canada)
WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended,
authorizes municipalities to pass by-laws respecting matters within the sphere of
jurisdiction of highways, including parking and traffic on highways;
AND WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide
that the powers of a municipality under this or any other Act shall be interpreted
broadly so as to confer broad authority on the municipality to enable the
municipality to govern its affairs as it considers appropriate and to enhance the

powers and privileges of a natural person for the purpose of exercising its
authority under this or any other Act;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it necessary to upgrade crosswalk units at two locations on Queen Street
(Lambton and Harbour Streets) in the Municipality of Kincardine;
AND WHEREAS there is a limited source of supply for the goods to be
purchased as per Report Public Works 2021-09;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
deem it expedient to accept a quote from Econolite Canada to supplyreplacement
crosswalk cabinets and pushbuttons for the Queen Street crosswalks;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the quote of Econoline Canada to supply replacement crosswalk
cabinets and pushbuttons for crosswalks on Queen Street (Lambton and
Harbour Streets) in the Municipality of Kincardine, in the amount of
$52,265.97 (including the non-refundable portion of HST), be hereby
accepted.
2. That this quote be exempt from Purchasing and Procurement Policy
GG.2.17 in accordance with Section 17.1 to allow for purchase direct from
supplier where there is a limited source of supply for the goods and
services to be purchased.
3. That the Mayor and Chief Administrative Officer be authorized and directed
to execute on behalf of The Corporation of the Municipality of Kincardine,
any contracts and other documents required to authorize such work to
commence.
4. This by-law shall come into full force and effect upon its final passage.
