THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2021 - 017
BEING A BY-LAW TO ASSUME THE STREET KNOWN AS CAMPBELL
AVENUE PLAN 151 EXCEPT PART 1 ON 3R-8438 AND PARTS 1-4 ON
REFERENCE PLAN 3R-8927 AS PART OF A PUBLIC HIGHWAY SYSTEM
FOR THE MUNICIPALITY OF KINCARDINE
WHEREAS the Municipal Act, 2001, S.O. 2001, c.25 authorizes a municipality to
pass By-Laws regarding highways;
AND WHEREAS The Corporation of the Municipalityof Kincardine causeda
portion of Campbell Avenue; being Part 1 on Reference Plan 3R-8438, to be
stopped up and closed by by-law registered as Instrument No. BR9368;
AND WHEREAS The Corporation of the Municipality of Kincardine accepted a
dedication of Parts 1 \\ 4 on Reference Plan 3R-8927 for turning circles from
1697193 Ontario Limited and passed By-Law 2015-159 wherein it dedicated the
said Parts 1 to 4 on Reference Plan 3R-8927 as part of the Public Highway
System for the Municipality of Kincardine. The said By-Law provided that it shall
come into effect upon registration in the Bruce County Land Registry Office
(No.3);
AND WHEREAS By-Law 2015-159 was not registered in the Bruce County Land
Registry Office (No.3);
AND WHEREAS The Corporation of the Municipality of Kincardine has jurisdiction
over the landsdescribed as Campbell Avenue, Plan 151, Except PT 1 3R8438;
Kincardine and Parts 1 \\ 4 on Reference Plan 3R-8927;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
is desirous of establishing and assuming the lands described in this By-law as
public highway for public use;
NOW THEREFORE theCouncil of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1.That the lands described as Campbell Avenue Pl 151, Except Pt 1 3R8438;
Kincardine; being all of PIN 33309-0401 (LT), arehereby assumed by The
Corporation of the Municipality of Kincardineinto its Public Highway
System as a public highway knoXP CT \]CAMPBELL AVENUE^$

2. That the lands described as Part Lots 7 & 8 Plan 151, Part 1 3R-8927;
Municipality of Kincardine; being all of PIN 33309-0424 (LT), are hereby
established and assumed by The Corporation of the Municipality of
Kincardine as a pVDNKE JKIJXCZ MPQXP CT \]CAMPBELL AVENUE^$
3. That the lands described as Part Lot 9 Plan 151, Part 2 3R-8927;
Municipality of Kincardine; being all of PIN 33309-0421 (LT), are hereby
established and assumed by The Corporation of the Municipality of
Kincardine CT C RVDNKE JKIJXCZ MPQXP CT \]CAMPBELL AVENUE^$
4. That the lands described as Part Campbell Avenue Plan 151 Closed by
BR9368, Part 3 3R-8927; Municipality of Kincardine; being all of PIN
33309-0419 (LT), are hereby established and assumed by The Corporation
of the Municipality of Kincardine as a public highway known as
\]CAMPBELL AVENUE^$
5. That the lands described as Part Lots 14 & 15 Plan 151, Part 4 3R-8927;
Municipality of Kincardine; being all of PIN 33309-0422 (LT), are hereby
established and assumed by The Corporation of the Municipality of
Kincardine CT C RVDNKE JKIJXCZ MPQXP CT \]CAMPBELL AVENUE^$
6. That By-Law No. 2015-159 is hereby be repealed.
7. This by-law shall come into full force and effect upon its final passage.
