(5019386 Ontario Inc.), By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2020 - 142 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 2003 - 25, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE 5019386 Ontario Inc. c/o Jamie Shepherd Kincardine Con A PT LOT 18; RP 3R10316 PARTS 1 TO 4; and Kincardine Con A PART LOT 18; RP3R10305 PART 1 (Kincardine Township) WHEREAS Section 34 of the Planning Act, R.S.O. 1990 Chapter 13 authorizes the Councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine has enacted By-law No. 2003 -25, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine desires to amend By-law No. 2003 - 25; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. ?DIFETLF\[0\\SO1X-law No. 2003- 25 as amended, is hereby further BMFNEFECXDIBNHJNHSIFQFONGQOMSIF\[>FRJEFNSJBL<NF>% \\AOne to the \[>FRJEFNSJBL@IQFF>'-y-H) Zone on those lands described as KINCARDINE CON A PT LOT 18; RP 3R10316 PARTS 1 TO 4; and KINCARDINE CON A PART LOT 18; RP3R10305 PART 1 (Kincardine @OVNRIJP !BROTSLJNFEONSIFBSSBDIFE?DIFETLF\[0\\# 2. A maximum of 36 townhouses shall be permitted. 3. Notwithstanding the provisions of Section 14.2.3, on lands described as \[>'- y-H\\SIFGOLLOVJNHPQOUJRJONRRIBLLBPPLX. a.The end of a unit shall be a minimum of 5.2 m from the edge of a road; b.The rear of a unit shall be a minimum of 6 m from the property line; c. The end of a unit shall be a minimum of 3.3 m from the property line. 4. The development shall be under site plan control. 5. The Holding (H) symbol may be removed after the granting of site plan control approval. 6. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 7.
