BY-LAW
NO. 2020 - 133
BEING A BY-LAW TO AMEND BY LAW NO. 2012 ; 086; BEING A BY-LAW
TO PERMIT RETAIL ESTABLISHMENTS TO BE OPEN ON SPECIFIC
HOLIDAYS
WHEREAS Section 8 (1) and 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provides that the powers of a municipality under this or any other Act
shall be interpreted broadly so as to confer broad authority on the municipality to
enable the municipality to govern its affairs as it considers appropriate and to
enhance the municipalENSUM ability to respond to municipal issuesandhas the
capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under this or any other Act;
AND WHEREAS under Section 4(1) of the Retail Business Holidays Act
(hereiI=BNAL ?=GGA@ NDA V/?NW as amended, a municipality may permit retail
business establishments to be open on holidays for the maintenance or
development of tourism;
AND WHEREAS an application has been made by one or more persons carrying
on retail business in the municipality that Council consider amending By-law No.
2012 - 086, V0AEIC = 0S-law to Permit Retail Establishments to be Open on
Specific HolidayMW to expand the designated area;
AND WHEREAS the Municipality held a public meeting on October 14, 2020,
notice of which was published in the local newspaper having general circulation
in the municipality, at which persons in attendance were given the opportunity to
make representation in respect of the said by-law;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
is satisfied that the tourism criteria as set out in the regulations of the Act have
been met;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1.That Section 2 of By-law No. 2012 T 086 be amended with the additionof
Schedule V0W attached hereto, included as a designated area.
2.That this By-law shall come into full force and effect on the thirty-first day
from the passing thereof unless appealed to the Local Planning Appeal
Tribunal (LPAT) pursuant to Section 4.3 of the Act.
