HomeMy WebLinkAbout20 123 Bronkhorst Drain Agreement (2020) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2020 - 123 BEING A BY-LAW TO AUTHORIZE THE SIGNING OF A MUTUAL AGREEMENT FOR DRAINAGE WORKS (Bronkhorst Drain) WHEREAS Section 8(1) and 9 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the unicipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS under Section 2 of the Drainage Act, RSO 1990 when two or more owners of land desire to construct or improve a drainage works on any of their lands and are willing to pay the cost thereof, they may enter into a written agreement for the construction, improvement, financing and maintenance of such drainage works; AND WHEREAS Johannes Jurie Bronkhorst & Elizabeth Renee Bronkhorst desired an outlet for Lot 30, Concession 5 which will affect a portion of Municipal property; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it advisable to enter into a mutual agreement for the Bronkhorst Drain as per Report Public Works-2020-37; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That The Corporation of the Municipality of Kincardine enter into the Bronkhorst Drain Agreement with Johannes Jurie Bronkhorst & Elizabeth Renee Bronkhorst, Bruce Campbell Crossley & Gail Marie Crossley and Ashley Ellen Richards, . 2. That the Mayor and Chief Administrative Officer be authorized and directed to execute, on behalf of The Corporation of the Municipality of Kincardine, the Bronkhorst Drain Agreement, attached hereA forming part of this By-law as well as any other documentation required. 3. That this By-law shall come into full force and effect upon its final passage. 4. From the outlet the drain is located in a west direction across Lot 31 Concession 5, running parallel to and north of the north boundary of Concession Road 5,to the east boundary of Sideroad 30S, a new CB will be installed at or near the east boundary of Sideroad 30S, the drain will then cross Sideroad 30 and end at or near the west boundary of Sideroad 30.A catch basin will be installed at or near the west boundary of Sideroad 30S. (A map of the specific location of the drain is available at the office of the Corporation of the Municipality of Kincardine) Construction Construction of the drain will take place in August 2020. The contractor is to locate the existing tiles at the south end of Lot 31 Concession 5 prior to any work being commenced and any damages will be repaired in a timely manner. Maintenance Party of the First Part shall have access to the drain for maintenance. Party of the Second Part,Third Part and Fourth Part shall inform the Party of the First Part if the Drain requires Maintenance and shall grant access for the repairs. Any fences that are damaged shall be repaired by the Party of The First Part Any tiles that are damaged shall be repaired by the Party of The First Part Any future maintenance shall be paid as stated under Costs. Any work on the road must not be started without proper permits and approvals from the Municipality. Costs The entire cost of the construction of the drain and future maintenance shall be paid in the following proportions: 100% Party of the First Part. Estimated cost: $15000 This agreement herein contained when executed by the Party hereto,shall be registered in the proper Registry Office and any costs shall be borne by the Party of the First Part. The provisions herein contained shall endure to the benefit of and be binding upon the parties hereto and their respective heirs,administrators, executors, successors and assigns.
