HomeMy WebLinkAbout05 027 community consultation THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE • KBT • . , • WY OF YlOkf BY -LAW NO. 2005 - 027 BEING A BY -LAW TO RECEIVE THE RESULTS OF A COMMUNITY CONSULTATION CONDUCTED BY THE STRATEGIC COUNSEL TO DETERMINE PUBLIC OPINION REGARDING A DEEP GEOLOGIC REPOSITORY FOR THE MANAGEMENT OF LOW AND INTERMEDIATE LEVEL WASTE WITHIN THE MUNICIPALITY OF KINCARDINE • WHEREAS Section 130 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may regulate matters for purposes related to the health, safety and well being of the inhabitants of the municipality; AND WHEREAS pursuant to the said Municipal Act, Sections 8 and 9 (1), municipalities are provided with powers of a natural person to enable them to govern their affairs as they consider appropriate and to enhance their ability to respond to municipal issues; AND WHEREAS The Council for the Corporation of the Municipality of Kincardine authorized entering into an agreement with Ontario Power Generation Inc. for the management of low and intermediate level nuclear waste within the Municipality of Kincardine with the adoption of By -law No. 2004 — 157; AND WHEREAS the agreement with Ontario Power Generation Inc. requires that an independent community consultation be carried out by the Municipality to ascertain the support of permanent and seasonal residents 18 years of age and • older towards a deep geologic repository for the storage of low and intermediate level nuclear waste at the Western Waste Management Facility at the Bruce Power Site; AND WHEREAS The Council for the Corporation of the Municipality of Kincardine contracted with The Strategic Counsel for the provision of professional services to conduct an independent community consultation with the adoption of By -law No. 2004 —176, amended by By -law No. 2004 — 182; AND WHEREAS Council, by the adoption of By -law No. 2004 — 189 established the process by which The Strategic Counsel would solicit the views of permanent and seasonal residents 18 years of age and older concerning a deep geologic repository for the storage of low and intermediate level nuclear waste; AND WHEREAS The Council for The Corporation of the Municipality of Kincardine contracted with BDO Dunwoody LLP for the provision of professional services with the adoption of By -law No. 2004 — 182 to conduct an Auditors' Report on Compliance in all material respects with the criteria established by By- • laws No. 2004 -176, 2004 -182 and 2004 -189; .../2 Page 2 Community Consultation Results By -law No. 2005 - 027 NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That Council hereby accepts from The Strategic Counsel the "Consultation Methodology and Response Rates ", dated February 16, 2005, resulting from a Community Consultation regarding a deep geologic repository for long term management of low and intermediate level nuclear waste and attached to this by -law as Schedule "A ". 2. That Council hereby accepts from BDO Dunwoody LLP the "Auditors' Report on Compliance with By- laws ", dated February 11, 2005, and attached to this by -law as Schedule "B ". 3. That Council deems the results of the community consultation to be a clear mandate from permanent and seasonal residents, 18 years of age and over, for the establishment of a deep geologic repository for the storage of low and intermediate level nuclear waste. 4. This by -law shall come into full force and effect upon its final passing. • 5. This by -law may be cited as the "Community Consultation Results By -law ". (519) 832-5659 Dr\1 nil growth · Auditors' Report on Compliance with Bylaws To The Council for the Corporation of the Municipality of Kincardine · We have audited The Strategic Counsel's compliance as at 11th February, 2005 with the criteria established by Bylaw 2004·176, Bylaw 2004-182 and Bylaw 2004-189 being bylaws to determine the process for the community consultation to be conducted by the strategic counsel to determine public opinion regarding the management of low and intermediate level waste with the Municipality of Kincardine and the interpretation of such agreement as set out in the note attached, Compliance with the criteria established by the provisions of the By-laws is the responsibility of the management of The Strategic Counsel. Our responsibility is to express an opinion on this compliance based on our audit. We conducted our audit in accordance with Canadian generally accepted auditing standards, Those standards require that we plan and perform an audit to obtain reasonable assurance whether The Strategic Counsel complied with the criteria established in the By-laws referred to above, Such an audit includes examining, on a test basis, evidence supporting compliance, evaluating the overall compliance with the agreement, and where applicable, assessing the accounting principles used and significant estimates made by management. In our opinion, as at 11th February, 2005, The Strategic Counsel is in compliance, in all material respects, with the criteria established by Bylaw 2004-176, Bylaw 2004-182 and Bylaw 2004-189. Pollsters employed by The Strategic Counsel, when conducting the community consultation, will pose the following preamble and question: Preamble 'The Kincardine Council has expressed its support for the long-term management of low and intermediate level nuclear waste in a deep geologic repository to be owned and operated by Ontario Power Generation at the Western Waste Management Facility located at the Bruce site. Council's decision was based on the following key points: It provides the highest level of safety of any option. There will be a rigorous environmental assessment and Canadian Nuclear Safety Commission regulatory process that includes opportunities for public input before construction is approved, The deep geologic repository will permanently isolate the low and intermediate level waste stream, much of which is already stored on site. II provides significant economic benefit to the residents of the Municipality. No high level waste or used nuclear fuel would be allowed in the facility. In summary, Council believes it is important to solicit the views of residents.'
