BY-LAW
NO. 2003 - 30

BEING A BY-LAW DESIGNATING CERTAIN LANDS "ITHIN
THE FORMER VILLAGE OF TIVERTON, NOT TO IBE
A REGISTERED PLAN OF SUBDIVISION
WHEREAS the Planning Act, R.S.O. 1990 c. P13, Section 50 ( ) authorizes the
Council of a Municipality to pass a By-law designating any Plan f Subdivision, or
part thereof, that has been registered for eight years or m re, not to be a
registered Plan of Subdivision for the purposes of Subsecti n 50 (3) of the
Planning Act; I
AND WHEREAS certain lots described on Registered Pla~ of Subdivision
123 are within the former Village of Tiverton in the Municipality qt Kincardine;

AND WHEREAS the said Plan of Subdivision No. 123 was registered in the
Registry Office for the Registry Division of the County of Bruce 1n the 28th day of
October, 1874;
NOW THEREFORE the Council for The Corporation of thþ Municipality of
Kincardine ENACTS as follows: I

1. That the Registered Plan of Subdivision or parts thereof d1' cribed as follows
is hereby designated to be a Plan of Subdivision which sh II be deemed not
to be a Registered Plan of Subdivision for the purposes Subsection 3 of
Section 50 of the Planning Act, R.S.O. 1990. I

2. That the lands subject to this by-law are described as Lot 3~ and Lot 33, Plan
123, in the Municipality of Kincardine (formerly the Villrge of Tiverton),
County of Bruce. I
3. That the Clerk of the Municipality of Kincardine shall cause ia certified copy of
this by-law to be lodged in the office of the Minister and to ~e registered in the
Land Registry Office for the County of Bruce as required b'vi the said Planning
Act, Sections 50 (26) and (28). I
4. That notice of the passing of this by-law shall be given witlin 30 days of the
passing, to the owners listed on the last revised assessm~~t roll, as required
by the said Planning Act, Section 50 (29). '

5. That the Council of the Municipality of Kincardine shall h~ar in person òr by
agent any person to whom a notice was sent and who wi hin 20 days of the
mailing of the notice applies to be heard, respecting the A endment or repeal
of this by-law. ¡

6. This by-law shall come into full force and effect on its final p~ssing.
7. This by-law may be cited as the "Lots 32 and 33, Plan 123 (Former Village of
Tiverton) Deeming By-law."

THE FORMER VILLAGE OF TIVERTON, NOT TO BE

WHEREAS the Planning Act, R.S.O. 1990 c. P13, Section 50 (4) authorizes the
