HomeMy WebLinkAbout20 006 Management Employee Negotiations Memorandum of Understanding By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT ,�C/lgLlry OF 1:11, BY-LAW NO. 2020 - 006 BEING A BY-LAW TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE MANAGEMENT EMPLOYEES OF THE MUNICIPALITY OF KINCARDINE WHEREAS Sections 8 (1) and 9 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to • enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS By-law No. 2016 - 005 was passed on the 13th day of January, 2016 to establish personnel policies for the employees of the Municipality of Kincardine and reflect the negotiation settlements; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it expedient to enter into an agreement to reflect the updated negotiation settlements with the employees of the Municipality of Kincardine; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That The Corporation of the Municipality of Kincardine enter into a Memorandum of Understanding with the management employees of the Municipality, attached hereto as Schedule 'A'. • 2. That the provisions provided herein supercede any by-laws which are inconsistent with the provisions provided in this by-law. 4. This by-law shall come into full force and effect upon its final passing. 5. This by-law may be cited as the "Management Employee Negotiations Memorandum of Understanding By-law". READ a FIRST and SECOND TIME this 13th day of January, 2020. READ a THIRD TIME and FINALLY PASSED this 13th day of January, 2020. Mayor Clerk • MEMORANDUM OF UNDERSTANDING This MEMORANDUM OF UNDERSTANDING ("Memorandum") made in duplicate and entered as of January 13, 2020 by and between: MUNICIPALITY OF KINCARDINE SENIOR MANAGEMENT EMPLOYEES' GROUP (the "Employees") - and - THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE (the "Municipality") AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it expedient to enter into a Memorandum with the Employees, to reflect the updated negotiation settlements; NOW THEREFORE the following will be effective January 1, 2020: ➢ WAGES 2020 = 2.5% 2021 = 2.0% + Market Study (indexed) 2022 =Min. 1.75% or CPI Protection up to 2.5% 2023 = Min. 1.75% or CPI Protection up to 2.5% ➢ VISION Benefit carries a maximum of$400 every 24 months vs $350 ➢ ORTHODONTIC BENEFIT Increase lifetime maximum to $2,000 from $1,500 ➢ PRESCRIPTION DRUGS DISPENSING The $2 co-pay per prescription will be eliminated ➢ TERM Four years AND FURTHER THAT all existing negotiable terms of employment benefits shall continue. AND FURTHER THAT there will be parity amongst all three labour groups (Senior Management, Non-Management and Firefighters) on any negotiated changes to existing compensation & benefits that they currently receive. IN WITNESS WHEREOF the parties hereto have executed this Memorandum and it is understood it will be presented to Council and ratified by By-Law.
