THOMPSON PUBLIC SCHOOL (Weiler's Cleaning and Restoration Ltd.) WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted 1111 broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS it has been determined that there is a need for professional maintenance services at the former W.E. Thompson Public School; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That The Corporation of the Municipality of Kincardine enter into an agreement for professional maintenance services at the former W.E. Thompson Public School with Weiler's Cleaning and Restoration Ltd., in accordance with the terms and conditions outlined in the agreement attached hereto as Schedule 'A' and forming part of this by-law. 2. That the Mayor and Chief Administrative Officer be authorized and directed • to execute, on behalf of the Council of The Corporation of the Municipality of Kincardine, any contracts and other documents required to authorize such work to commence. 3. That the acquisition of maintenance services at the Bruce Power Training Centre be exempt from Purchasing & Procurement Policy GG.2.17 in accordance with section 17 of the Policy to allow purchase by negotiation as the extension of the existing contract would prove more cost effective and beneficial. 4. This by-law shall come into full force and effect upon its final passage. 5. This by-law may be cited as the "Professional Maintenance Services at the former W.E. The Contractor shall furnish copies of all mandatory documentation prior to the final execution of the contract. 5. Either party may terminate the contract upon 120 days written notice. 6. Any notice which either of the parties is required or permitted to give pursuant to any provisions of this agreement shall be given in writing by hand delivery or by registered mail addressed as set out below.
