BEING A BY-LAW TO TEMPORARILY CLOSE VARIOUS STR ETS TO HOLD A
KINCARDINE BUSINESS IMPROVEMENT AREA HOME TO N CHRISTMAS

WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, as ame ded, authorizes the
councils of all municipalities to close on a temporary basis an highway under the
jurisdiction of the municipality for such social, recreational, co munity, athletic or
cinematographic purpose as may be specified in a by-law;
AND WHEREAS the Board of Management of the Kincardine B siness Improvement
Area has requested the closure of certain streets in order to h Id its annual "Home
Town Christmas" activities on Friday, November 26,2004;
NOW THEREFORE the Council for The Corporation of the Muni ipality of Kincardine
ENACTS as follows:
1 .
That part of Queen Street, Municipality of Kincardine fro the north side of
Durham Market Square South to Durham Street; and Du am Market North,
east of Queen Street to Princes Street, be closed to all vehicular traffic on
November 26,2004 from 5:00 p.m. to 10:00 p.m.
The Board of Management of the Kincardine Business 1m rovement Area shall
erect at each end of such highway or portion thereof, and where an alternative
route deviates therefore, a barricade upon which an ade uate warning device
shall be exposed and in good working order and at such oints there shall be
erected a detour sign indicating the altemative route and ntaining a notice that
the highway is closed to traffic.
Every person who uses a highway or portion of a highwa so closed to traffic
does so at his or her own risk and The Corporation 0 the Municipality of
Kincardine is not liable for any damage sustained by a pers n using the highway
or portion thereof so closed to traffic.
Every person who without lawful authority uses a highway 0 portion thereof so
closed to traffic while it is protected in accordance with this aragraph, or who
removes or defaces any barricade, device, detour sign or n tice placed thereon
by lawful authority, is guilty of an offence and is subject to t e penalties as set
forth in the Provincial Offences Act and is also liable to The Corporation of the
Municipality of Kincardine for any damage or injury occasio ed by such wrongful
use, removal or defacement.

5. This bylaw shall come into full force and effect upon its final passage.
6. This by-law may be cited as the "Kincardine BIA Ho e Town Christmas
Temporary Road Closure 2004, By law n. ~'
