HomeMy WebLinkAbout19 164 Amendment to Comprehensive Zoning By-law No.2003-25, 1494 Highway 21 By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT� iktIr ►I/1 '..4:40134:11Y OF'A1NCP O BY-LAW No. 2019 - 164 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 2003 - 25, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE Pierson Motors c/o Davidson Part Lots 1 & 2, Concession 2 SDR (being Part 2, RP 3R-8758), Municipality of Kincardine (geographic Township of Kincardine) • WHEREAS Section 34 of the Planning Act, R.S.O 1990 Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine has enacted By-law No. 2003 - 25, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine desires to amend By-law No. 2003 - 25; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003 - 25 as amended, is hereby further amended by changing thereon from the `Planned Development' Zone to the `Highway Service Commercial Special Holding (C2-s-h)' Zone on those lands described as Part Lots 1 & 2, Concession 2 SDR, (being Part 2, RP 3R-8758), Municipality of Kincardine (geographic Township of Kincardine), • as outlined on the attached Schedule 'A'. 2. By-law No. 2003 - 25, as amended, being the Comprehensive Zoning By- law for the Municipality of Kincardine, is further amended by adding the following paragraph: 18.4.15 Despite their `C2' zoning designation, those lands as delineated as `C2-s-h' on Schedule 'A' to this by-law may be used for Highway Service Commercial purposes in compliance with the C2 zone provisions contained in this By-law, exception however, that: i. The lands may be serviced with private septic systems and private wells, subject to the approval of the Municipality of Kincardine ii. The Holding Provision will be removed upon the receipt of confirmation from the Ministry of Culture, Tourism and Sport that the Archeological Assessment conducted on the property has been accepted into the Public Register of Archeological Reports and no further assessment is required. • Page 2 of 2 Amendment to Comprehensive Zoning By-law No. 2003 - 25, 1494 Highway 21, By-law By-law No. 2019 - 164 • 18.4.16 Despite their `C2' zoning designation, those lands as delineated as `C2-t-h' on Schedule 'A' to this by-law may be used for Highway Service Commercial purposes in compliance with the C2 zone provisions contained in this By-law, exception however, that: i. The lands may be serviced with private septic systems and private wells, subject to the approval of the Municipality of Kincardine ii. "Warehouse, mini storage" shall be a permitted use; iii. The Holding Provision will be removed upon the receipt of confirmation from the Ministry of Culture, Tourism and Sport that the Archeological Assessment conducted on the property has been accepted into the Public Register of Archeological Reports and no further assessment is required. 3. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. • 4. This By-law may be cited as the "Amendment to Comprehensive Zoning By-law No. 2003 - 25, 1494 Highway 21, By-law". READ a FIRST and SECOND TIME this 9th day of December, 2019.
