NO. 2019 - 150
BEING A BY-LAW TO AMEND BY-LAW NO. 2017 - 166; BEING A BY-LAW TO
ESTABLISH A MULTI-YEAR ACCESSIBILITY PLAN FOR
THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 (the Act) Sections 8 and 9
(1) provide municipalities with the powers of a natural person to enable them to
govern their affairs as they consider appropriate under this or any other Act and to
• enhance their ability to respond to municipal issues;
AND WHEREAS by Ontario Regulation 191/11 a Municipality shall establish,
implement, maintain and document a multi-year accessibility plan, which outlines
the organization's strategy to prevent and remove barriers and meet its
requirements under this Regulation;
AND WHEREAS on December 6, 2017 Council passed By-law No. 2017 - 166 to
adopt the Municipality of Kincardine Multi-Year Accessibility Plan 2018 - 2022;
AND WHEREAS Council deems it advisable to amend By-law No. 2017 - 166 to
include a section on Preventative and Emergency Maintenance of Accessibility
Elements as required by Section 80.44 of Ontario Regulation 191/11: Integrated
Accessibility Standards.;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That Municipality of Kincardine Multi-Year Accessibility Plan 2018 - 2022
• attached as Schedule "A" to By-law No. 2017 - 166, be amended to include the
following:
Preventative and Emergency Maintenance of Accessibility Elements
As required under the Design of Public Spaces Standards (Accessibility
Standards for the Built Environment) the Multi Year Accessibility Plan includes
the following procedures for preventative and emergency maintenance of the
accessible elements in public spaces and for dealing with temporary
disruptions when accessible elements are not working.
The Design of Public Spaces Standard applies to public spaces that are newly
constructed or redeveloped, that include:
• Recreational trails and beach access routes;
• Outdoor public use eating areas;
• Outdoor play spaces;
• Exterior paths of travel;
• • • Accessible parking.

Departments that maintain elements listed under these areas:
• • Shall apply best practices in the preventative maintenance of accessible
elements with periodic checks such as:
• Annual inspections or more frequently as per the Minimum Maintenance
Standards;
• After storms or events that might affect accessible elements;
• As part of any report of vandalism or complaints.
• Shall apply best practices in the emergency maintenance of accessible
elements with active response once notified.
• Shall continue to provide public notification of temporary disruptions in
keeping with compliance requirements under the Integrated Accessibility
Standard Regulation (0. Reg 191/11) and the Municipality's GG.3.8
Accessibility Standards for Customer Service Policy. This will include:
• Notice of the disruption will include: the reason for the disruption, its
anticipated duration and a description of alternative facilities or services,
if any, that are available
4. This By-law shall come into full force and effect upon its final passage.
• 5. This By-law may be cited as the "Multi-Year Accessibility Plan 2018 - 2022
Amendment (1) By-law".
