HomeMy WebLinkAbout19 148 Public Nuisance Amendment (1) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE AKBTy_ • 0 % ��m '�,,�ur BY-LAW NO. 2019 - 148 BEING A BY-LAW TO AMEND BY-LAW NO. 2013-073; BEING A BY-LAW TO PROHIBIT OR REGULATE PUBLIC NUISANCES WITHIN THE MUNICIPALITY OF KINCARDINE WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the • municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine passed By-law No. 2013 - 073, the Public Nuisance By-Law on June 12, 2013; AND WHEREAS the Council deems it necessary to amend By-law No. 2013 - 073 to add an additional public nuisance; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That By-law No. 2013 - 073, Public Nuisance By-law be amended as follows: i. That Section 1 Definitions be amended to include "Bridge" means a structure spanning and providing passage across a • waterway, road, walkway or other obstacle." ii. That following Sections be renumbered: Section 6 — Order to Discontinue Activity to be Section 7 Section 7 — Close Public Highways to be Section 8 Section 8 — Enforcement and Inspection to be Section 9 Section 9 — Penalty to be Section 10 Section 10 — Severability to be Section 11 Section 11 — Miscellaneous to be Section 12 iii. That Section 6 be added: 6. Bridges 6.1 — No person shall jump, dive, leap, or throw any object off or from any bridge located within the boundaries of the Municipality. 2. The setting of the fines does not constitute my approval of the short form of wording used to describe the offences. I have forwarded the copy of the Order and the schedules of set fines to the Provincial Offences Court in Owen Sound, together with a copy of the By-law.
