BEING A BY-LAW TO ACCEPT A TENDER FOR
GRASS CUTTING IN THE MUNICIPALITY OF KINCARDINE
(Mike Leggett Landscape Solutions)
WHEREAS Sections 11 (1) and (3) of the Municipal Act, 2001, S.O. 2001, c. 25 as
amended gives broad authority to lower-tier municipalities to provide any service or
thing that the municipality considers necessary or desirable for the public and
• respecting matters within the sphere of jurisdiction of culture, parks, recreation and
heritage;
AND WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide
that the powers of a municipality under this or any other Act shall be interpreted
broadly so as to confer broad authority on the municipality to enable the municipality
to govern its affairs as it considers appropriate and to enhance the municipality's
ability to respond to municipal issues and has the capacity, rights, powers and
privileges of a natural person for the purpose of exercising its authority under this
or any other Act;
AND WHEREAS it has been determined that there is a need within the Municipality
of Kincardine for grass cutting on municipally-owned property in Underwood and
Bervie/Armow as outlined in Report Rec 2019-04;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the following tenders of Mike Leggett Landscape Solutions, for grass
• cutting for the years 2019-2022 be hereby accepted:
i) Underwood - in the amount of $224.64 per cut, including the non-
refundable portion of HST;
ii) Bervie/Armow - in the amount of $387.71 per cut, including the non-
refundable portion of HST;
2. That the contract with Mike Leggett Landscape Solutions be for the years
2019 through 2022 inclusive.
3. That Mike Leggett Landscape Solutions base price for 2019 will increase by
the Consumer Price Index (CPI) Index (Federal) for 2020, 2021 and 2022.
4. That the Mayor and Chief Administrative Officer be hereby authorized and
directed to sign and execute, on behalf of the Council for The Corporation of
the Municipality of Kincardine any contracts and other documents required
to authorize such work.

5. This by-law shall come into full force and effect upon its final passage.
• "Grass This by-law may be cited as the Cutting Tender Acceptance 2019-
2022 (Mike Leggett Landscape Solutions) By-law".
READ a FIRST and SECOND TIME this 1st day of April, 2019.
READ a THIRD TIME and FINALLY PASSED this 1st day of April, 2019.
