HomeMy WebLinkAbout19 028 Municipality of Kincardine 2013 Procedure By-law Amendment (9) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT V • i3 , �� BY-LAW NO. 2019 - 028 BEING A BY-LAW TO AMEND BY-LAW NO. 2013 - 161; BEING A BY-LAW TO GOVERN THE CALLING, PLACE AND PROCEEDINGS OF MEETINGS WHEREAS pursuant to Subsection 238 (2) of the Municipal Act, 2001, S.O. 2001, c.25, every municipality and local board shall pass a procedure by-law for governing the calling, place and proceedings of meetings; • AND WHEREAS pursuant to Subsection 238 (2.1) of the Municipal Act, 2001, S.O. 2001, c.25, the procedure by-law shall provide for public notice of meetings; AND WHEREAS the Council of The Corporation of the Municipality passed By- law No. 2013 - 161 to govern the calling, place and proceedings of meetings; AND WHEREAS Council deems it advisable to amend By-law No. 2013 - 161; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That sections of A23.1 of Schedule "A" of By-Law No. 2013 - 161 be repealed and replaced with the following: Every member present, when a question is put, shall vote thereon unless the member has a pecuniary interest, direct or indirect. When a member has such interest in the question under debate, he/she shall so advise the Council in accordance with the provisions of the Municipal Conflict of Interest Act. Members shall file, with the Clerk, a • written statement of interest and its general nature at a meeting, on the form prescribed by the Clerk, at which a member discloses an interest, or as soon as possible afterwards. Except as follows, the member shall, in instances where the Council is meeting in a closed session, vacate his/her chair and the meeting room until the question is decided, and the Clerk shall duly record the circumstances in the minutes. Where the matter under consideration is whether to suspend the remuneration paid to the member if the Integrity Commissioner has reported that, in his or her opinion, the member has contravened the Code of Conduct, the member may take part in the discussion even at a closed meeting, however, the member is not permitted to vote on any question in respect of the matter. If any member present refuses to vote except for reasons of such interest, they shall be recorded as voting in the negative on the question before Council. • Page 2 of 2 Municipality of Kincardine 2013 Procedure By-law Amendment (8) By-law By-law No. 2019 - 028 2. That section of A10.1 of Schedule "A" of By-Law No. 2013 - 161 be amended with the addition of"Chief Administrative Officer Announcements" • after "Members of Council General Announcements" in both the Regular meetings and Planning/Corporate Services Meetings; and further that the numbering be amended accordingly. 3. That this By-law shall come into full force and effect on March 01, 2019. 4. This By-law may be cited as the "Municipality of Kincardine 2013 Procedure By-law Amendment (9) By-law".
