BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 2003-25, BEING THE
COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF
KINCARDINE

and 2. Municipality of Kincardine (geographic Township of Kincardine)
• WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes
the Councils of Municipalities to enact and amend zoning by-laws which comply
with an approved official plan;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
has enacted By-law No. 2003 - 25, a zoning by-law enacted under Section 34 of
the said Planning Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law No. 2003 - 25;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. Schedule 'A' to By-law No. 2003 - 25 as amended, is hereby further
amended by changing thereon from `Planned Development (PD)' Zone to
`Residential Three Special (R3-x)' Zone on those lands described as
Concession A, Pt Lot 68, Plan 361, Lots 1 & 2 and Pt Lot 30, RP 3R-5977,
Parts 1 and 2, Municipality of Kincardine (geographic Township of
• Kincardine), as outlined on the attached Schedule 'A'.
2. By-law No. 2003 - 25 as amended, being the Comprehensive Zoning By-
law for the Municipality of Kincardine, is further amended by adding the
following paragraph, as follows:
14.3.16 Notwithstanding their `R3-x' zoning designation, those lands
delineated as `R3-x' on Schedule 'A' to the By-law may be used for the
`Residential Three' purposes in compliance with the `R3' zone
provisions contained in this By-law excepting however, that:
(i) Those dwellings and structures as existing on the date of passing of
this by-law are considered legal non-conforming and are permitted on
the subject lands.
(ii) That a maximum of three detached dwellings existing on the date of
passing of this by-law may be located on a single lot.
(iii) That new development on the property shall meet the provisions of
• the zoning by-law.
(iv) That the property be subject to Site Plan Control for any proposed
multi-unit development.

• 3. This By-law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, R.S.O.
1990.
4. This By-law may be cited as the "Amendment to Comprehensive Zoning
By-law 2003-25, (Con A, Pt Lot 68, Plan 361, Lts 1 & 2, and Pt Lt 30, and
RP 3R-5977, Pt 1 & 2, Municipality of Kincardine (Kincardine Twp)), By-
law".
READ a FIRST and SECOND TIME this 16th day of January, 2019.
READ a THIRD TIME and FINALLY PASSED this 16th day of January, 2019.
