Home My WebLink About18 070 Partial Release of Willow West Subdivision Plan 3M-99 By-lawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE i KBT • �G��PIi(INOF kIkGbP�\� i NO. 2018 - 070 BEING A BY-LAW TO PARTIALLY RELEASE LANDS FROM THE REGISTERED PLAN OF SUBDIVISION PLAN NUMBER 3M-99 (Willow West) WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the • municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS The Corporation of the Town of Kincardine entered into a subdivision agreement dated the 29th day of March, 1989 and registered in the Registry Office for the County of Bruce as Number LT25069; AND WHEREAS The Council for the Municipality of Kincardine may authorize a partial release of obligations on the owners of a lot for certain lands within the subdivision; AND WHEREAS it has been determined that the obligations of the owner, with the exception of lot grading requirements, have been met and the lands ready for a partial release; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: • 1. That the Mayor and Chief Administrative Officer be authorized to grant partial release, attached hereto as Schedule "A", of the lands in Registered Plan of Subdivision Plan 3M-99 (Willow West) (Town of Kincardine) agreement 2. That the Mayor and Chief Administrative Officer be authorized and directed to execute on behalf of The Corporation of the Municipality of Kincardine any required documents for said partial release. 3. This by-law shall come into full force and effect upon its final passage. 4. This by-law may be cited as the "Partial Release of Willow West Subdivision Plan 3M-99 By-law". Herein called the "Owner" WHEREAS the Owner entered into certain obligations in favour of the Corporation of the Municipality of Kincardine (formerly The Corporation of the Town of Kincardine) under a Subdivision Agreement ("The Agreement") registered against the lands hereinafter described as Instrument No. LT25069. AND WHEREAS the Owner has satisfied and fulfilled all of those obligations. NOW THEREFORE the Corporation of the Municipality of Kincardine releases the Owner from the obligations contained in the said Agreement, with the exception of the lot grading provisions in Section 5.1 in said Instrument No. LT25069, as amended, and certifies that all other provisions of that Agreement, as amended, are no longer binding with respect to the said lands.
