HomeMy WebLinkAbout17 174 2018 Consolidated Rates and Fees Amendment (1) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT� tria Ali '��0ALITY OF KIN�p� BY-LAW NO. 2017 - 174 BEING A BY-LAW TO ESTABLISH RATES AND FEES FOR SERVICES PERFORMED BY THE MUNICIPALITY OF KINCARDINE WHEREAS Section 391 (1) of the Municipal Act 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to pass by-laws imposing fees or charges on persons, • (a) for services or activities provided or done by or on behalf of it; (b) for costs payable by it for services or activities provided or done by or on behalf of any other municipality or any local board; and (c) for the use of its property including property under its control. AND WHEREAS municipal Councils have the authority to establish rates and fees under various acts; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine, with the passage of By-Law No. 2017-149, established rates and fees for services performed by the Municipality; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it necessary to amend Schedule `L' of By-law No. 2017-149 to revise the Development Charges in accordance with the most recent twelve month change in the Statistics Canada Quarterly, Construction Price Statistics, as per By-Law No. 2016-080 and Schedule 'M'to add a charge for Bruce Energy Centre customers with no sewage meter; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine • ENACTS as follows: 1. That Schedule `L' and Schedule 'M' of the Municipality of Kincardine 2018 Consolidated Rates and Fees By-law No. 2017-149 is hereby repealed and replaced with the attached Schedule `L' and Schedule `M'; 2. That this by-law shall come into full force and effect upon its final passage. 3. That this By-law may be cited as the "2018 Consolidated Rates and Fees Amendment (1) By-law". DEVELOPMENT AND CAPITAL CHARGES CONT'D 2018 Fee Applicable • Taxes For any subdivision agreements entered into prior to July 13,2011,capital charges are as follows: 2 Sanitary Sewer Capital Charges The charges referenced in(a)and(c)below will not apply in the case of a residential infill lot where a capital fee had previously been paid by means of old impost fees,frontage fees or where old existing documentation proves previous payment. a. Capital contribution for capacity Per each equivalent residential unit(ERU) $1,950.95 Building Unit ERU Single Detached Dwelling 1 Multi-unit 0.8 Apartment unit 0.6 Condo unit 0.6 Trailer Site in Trailer Park 0.6 I.C.I. Group—Industrial,commercial and institutional charges are site specific through site plan control. Any property,which undertakes a re-zoning of its status,will be subject to a review of its contribution to capital as a condition of the development review. b. Contribution to Sewer Reserve Fund To be determined at time of connection based on existing per user amount on hand in the Sewer Reserve Fund c. Sanitary Sewer Main Charge(Plus GST) Property owner to pay Municipality's cost including administration related to installation of the sanitary sewer main and all III3 Water Capital Charges The charges referenced in(a)and(c)below will not applyin the case of a residential infill lot where a capital fee had previously been paid by means of old impost fees,frontage fees or where old existing documentation proves previous payment. The charges referenced in(a)to(d)do not pertain to the Kincardine Water Treatment Plant Expanded Service Area that is governed under the water guiding principles dated August 30,2002 as amended. a.
