(J) THE CORPORATION OF THE VILLAGE OF T.LVJ2Cl'ON BY-LAW NUMBER ~ Being a by-law to regulate the installation and connection of building water services in the Village of Ti verton. AND WHERFAS, the Municipal Council of the Village of Ti varton deems it necessary to regulate the connection of public water services in the Village of Ti verton NOW THEREFORE, The Municipal Council of the Corporation of the Village of Tiverton ENACTS as follows: 1. Definitions Article 1. (A) "MunicipalitY" and " Corporation" shall mean the Corporation of the Village of .Ti varton. "Council" shall mean the Municipal Council of the Village of Tiverton "MinistrY" shall mean the Ministry of the Envoirment. '!Water Works System" shall mean the nrks and equip lent under the jurisdiction of the Corporation for the support or distribution of water or any part of such system. (B) (C) (D) (¡¡) '!'Superintendent" shall mean the Superintendent of the Water Works Department ( or employee of the Village Works Department if no Superinterxlent of Water Works Department) of the Municipality as appointed by Council. (F) "Clerk-Treasurer" shall mean the Clerk-Treasurer of the Village of Tiverton. (G) "Premises" shall mean the property being supplied or to be supplied with water and includes the portion of a multiple occupancy premises separately supplied. "User" shall include, as the context requires, the applicant for water supply, the owner or occupant of and the person to whom invoices are sent for water supplied to the affected premises. "Water Service" shall mean the pipes and fixtures used for the purpose of supplying any premises in the Municipality with water from the Water Works~blished by the Corporation and situated between the watørmain and the limit of the street on which the premises so supplied front or abut. "Private Water Service" shall mean the pipes and fixtures used for the purposes of supplying any premises in the Municipality with water from the wateI- works system established by the Corporation and situated between the stre'St line in front of or abutting the premises so supplied and the premises. (K) "Commercial User" shall mean the applicant for water supply, the owner or occupant of and the person to whom invoices are sent for water supplied to an;y premises in· which the water supplied is used directly or indirectly for or in the prosecution of any business, trade or ccmnercial undertaking. j -j. , " .,. ;-Þ' <- .' f:::~ ~ ARTICLE II Building Watermain Connections , (A) No unauthorized person shall uncover, make any connections with or opening into, use, alter or disturb any public watennain or appurtenances thereof. (B) All building services shall be subject to inspection by municipal inspector from the watermain to the street line. Persons desiring a watèr, service connection from the street line to the watermain shall make application on neees!l81'7 farms, to the Clerk. Upon approval of such application the applicant will PB7 t\{:e Treuurer, the sum of one hundred dollA..s ($100.00) to cover cost af all labour and materials required. to restore the street a1101lllllCe to a good state of repair. (C) All _ter service connections shall be constructed at the owner"s expense to the requirements of this by-law and the Road Superintendent (or Village Works Department Employee.) Permits for constructing such water service connections must be obtained from the Clerk's office and applications for such permission shall be made on approved forms furnished by the Village. The pemit applications shall be supplemented by any plans, specifications or other information considered pertinent in the judgement of the Road Superintendent. The applicant for the bnilM1'1g _tar service connection permit shall notify the Clerk when the connection is read¥ for iBspection and the approval of the connection fOllowing such inspections will be taken as. the approval of the permit. (D) (E) A separate and independent building connection shall be provided for every þn'¡l~TJg; except where one building stands at the rear of another on an interior lot and no private connection is a'vailable or can be constructed to the rear bnilñiT1g through an adjatning alley, court, 18rit or driveway, the building connection from the front building may be extanded to the rear building and the whole considered as one water service connection. (PI) Acceptable materials for water service connection pipes up and to including 2" in internal diameter are as follows: Soft Copper - Type "K" Pol¥ethe1ène Acceptable materials for _ter service connections pipes greater than 2" in internal diameter are as follows: '~, Ductible Iron Pol¥ethe1ene Pol¥ Vin;y1 Chloride All private _ter services to be approved water-tight. (G) The size of the _tar service connection shall be subject to the approval of '. the Roads Superintendent but in no event shall the diameter be less then 19 m.m. (H) Maintenance of the entire building service connection shall. be the responsibility of the property owner. ARTICLE III Protection from Drainage. (A) In default of any matter or thing being done as directed or required to be dons by this By-law by any person, such matter or thing shall be done at his expense and the Corporation of' the Village of Tiverton may recover the expense incurred in doing it by action or in like manner as municipal taxes. .. AND WHEREAS, the Municipal Council of the Village of Tiverton deems it necessary to make an amendment to regulate the connection of public water services in the Village of' Tiverton. IDW THEREFORE, the Municipal Council of the Corporation of' the Village of Tiverton enacts as follows: Article II Section (b) amended as follows: (b) All building service shall be subject to inspection by municipal inspector from the watermain to the street line. Persons desiring a water service connection from the street line to the watermain shall make application on necessary forms, to the Clerk. Upon approval of such application the applicant will pay to the Treasurer, the sum of one hundred dollars ($100.00) plus cost of all labour and materials required to restore the street allow- ance to a good state of repair. (C) The invalidity of any Article, paragraph, clause, sentence or provision of this ordinance shall n ot affect the validity of any other part of this ordinance which can be given effect without such invalid part or parts ARl'ICLE IV Powers and Authority of Inspectors. (A) The Road SUperintendent and other duly authorized employees of the Village of Ti verton bearing proper credentials and indentification shall be permitted to enter upon all properties for the purpose of inspection, observation, measurEment, sampling, and testing, in accordance with the provisions of this ordinance.
