CORPORATION OF THE TOWNSHIP OF BRUCE
BY-LAW NO. 81-17
BEING A BY-LAW to amend By-law 76-13, as amended, being the Restricted
Area By-law for the Corporation of the Township of Bruce.

WHEREAS the Council of the Corporation of the Township of Bruce pursuant
to Section 35, S.S. 24 & 25 of The Planning Act, R.S.O. 1970, c. 349, and
amendments thereto deems it desirable to amend its said Restricted Area By-law.
NOW THEREFORE the Council of the Corporation of the Township of Bruce enacts
as follows:
1. This By-law applies to part of Lot C, Concession 3, in the Township of
Bruce, in the County of Bruce and shown as "SUBJECT PROPERTY" on Schedule
"A" attached hereto and forming part of this By-law.
2. Notwithstanding the provisions of By-law No. 76-13 the lands shown on
Schedule "A" may be used and buildings and structures may be erected in
accordance with the provisions of this By-law.
3. The areas contained within the subject property and shown as "Industrial
Area" are subject to the following provisions:
(a) Uses Permitted
General Industry, feed mills, warehousing, packaging plants, rail
transportation terminals, bus and truck transportation terminals,
public parks, outside storage, and accessory administrative offices

(d) Loading Requirements
Loading or unloading facilities shall be provided in accordance
with the following regulations:

4. All land not shown as "Industrial Area" shall be subject to the provisions
of the Restricted Hazard Land (H-R) Zone of By-law No. 76-13.
5. Notwithstanding the provisions of subsection 4 of this by-law, utility
corridors and service roads and related structures may be permitted in
all areas on the subject property, except in any required side yard or
rear yard.
6. For the purposes of this By-law the following interpretations and
definitions shall apply.
(a) General Industry shall mean the assembling, manufacturing, making,
preparing, inspecting, ornamenting, treating, processing, altering,
repairing, warehousing, storing or adopting for sale or for further
processing or assembling any goods, natural resource materials,
substance, article or thing or any part therof as distinguished
from the buying and selling of commodities and the supplying of
personal services.
(b) Sanitary Sewer shall mean a system of underground conduits, operated
either privately, or by a municipal corporation or by the Ministry of
the Environment which carries sewage to a place of treatment or
disposal which meets the approval of the Ministry of the Environment.
(c) Landscaped Open Space shall mean the open unobstructed space on a
lot accessible from the street on which the lot is located and which
is suitable for the growth and maintenance of grass, flowers, bushes

and other landscaping and includes any surfaced walk, patio, planting
area, or similar area but does not include any driveway or ramp,
whether surfaced or not, any curb, retaining wall, parking area or
any open space beneath or within any building or structure.
(d) Piped Water Supply shall mean a distribution system of underground
piping and related storage, including pumping and purification
appurtenances operated by a municipal corporation, and/or the
Ministry of the Environment and/or a Public Utility Company and/or
a private interest and which has been approved by the Ministry of
the Environment.
7. Except as amended by this By-law all other provisions of By-law 76-13
shall apply to the subject property.
8. Part XXI of the Municipal Act applies mutatis mutandis to this By-law.
9. This By-law shall come into force and effect on the final passing thereof
by the Council of the Corporation of the Township of Bruce subject to
the provisions of the Planning Act and amendments thereto.
10. The Clerk be and is hereby authorized to give notice of this By-law in
the manner and form and to the persons prescribed by the regulations to
the Planning Act Pursuant to the Planning Act Subsection 35(24) and (25)
and amendments thereto.
