HomeMy WebLinkAboutBRU 81 023 Site Plan Control CORPORATION OF THE TOWNSHIP OF BRUCE BY-lAW NO. 81-23 BEING A BY-lAW to designate lands within the Corporation of the Township of Bruce as a Site Plan Control Area. . WHEREAS an approved Official Plan is in effect for the Corporation of the Township of Bruce. AND WHEREAS the Council of the Corporation of the Township of Bruce is empowered by Section 40 of The Planning Act R.S.O. 1980 chapter 379 to designate the whole or any part of the area covered by an Official Plan as a Site Plan Control Area. AND WHEREAS the Council deems it is desirable to designate lands within the Corporation as a Site Plan Control Area. NOW THEREFORE the Council of the Corporation of the Township of Bruce enacts as follows: 1. DEFINED AREA All lands within the territorial boundaries of the Township of Bruce save for the area extending from the shore of lake Huron to the international boundary line are hereby designated as a Site Plan Control Area. 2. APPROVAL OF PLANS No person shall undertake, or cause to be undertaken, any development in the Site Plan Control Area unless the Council of the Corporation of the Township of Bruce, or the Chief Building Official in cases as delegated by this by-law has approved of plans, drawings and other matters as referred to in Section 40 of The Planning Act, R.S.O. 1980 Chapter 379 and amendments thereto. 3. CONDITIONS OF APPROVAL As a condition of approval of the plans and drawings, the Corporation may require, among other things, highway widenings, access ramps to and from land, curbing, traffic signs, parking surfacing, walkways, lighting, landscaping, collection and storage of waste materials, easements, utility corridors, provision for storm drainage, provision for sanitary sewers and water services, grading and disposal of storm, surface, and waste water from land and buildings. 4. AGREEMENTS . As a condition of approval of any plans or drawings, the Corporation may require the owner of the lands to enter into one or more agreements dealing with any or all of the works or matters mentioned in the preceding clause or with the provision and approval of the plans and drawings and the maintenance, to the satisfaction of the corporation, and at the sole risk and expense of the owner any or all facilities and works including snow removal. -2- 5. EXECUTION OF AGREEMENTS . The Reeve and the Clerk be and they are hereby authorized to execute on behalf of the Corporation all the agreements as referred to in Section 4 above. 6. AGREEMENT REGISTRATION Any agreement may provide that the agreement shall be registered against the lands for which approval is requested at the expense of the owner. 7. ENFORCEMENT Section 325 of the Municipal Act, R.S.O. 1980, Chapter 302 as amended, shall apply to any approval or agreement authorized by the Councilor the Chief Building Official, and provides that in the event of default of any provision of any agreement by the owner, the Corporation may demand that provisions of the agreement be completed at the expense of the owner, or complete the work itself and recover the expense, with interest, in a like manner as municipal taxes. 8. DELEGATION The approval of plãns is provided for in Section 2 of this by-law where involving single family residential development or development of barns and silos it is hereby delegated to the Chief Building Official of the Corporation appointed pursuant to The Building Code Act. 9. PENALTY Every person who contravenes any of the provisions of this by-law is guilty of an offence and on conviction by a Court of competent jurisdiction is liable to a fine as provided by law exclusive of costs. 10. This by-law comes into force and effect upon the final passing thereof by the Council of the Corporation of the Township of Bruce.
