BEING A BY-LAW TO ENTER INTO AN AGREEMENT WITH THE BRUCE
COUNTY LIBRARY BOARD REGARDING THE PROVISION OF LIBRARY
FACILITIES AND SERVICES
WHEREAS the Municipal Act, 2001 Section 8 (1) and 9 provide that the powers
of a municipality under this or any other Act shall be interpreted broadly so as
to confer broad authority on the municipality to enable the municipality to govern
• its affairs as it considers appropriate and to enhance the municipality's ability
to respond to municipal issues and has the capacity, rights, powers and
privileges of a natural person for the purpose of exercising its authority under this
or any other Act;
AND WHEREAS it has been determined that there is a need to enter into an
agreement with the Bruce County Library Board regarding the provision of library
facilities and services;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That The Corporation of the Municipality of Kincardine enter into an
agreement with the Bruce County Library Board regarding the provision of
library facilities and services, in accordance with the terms and conditions
outlined in the agreement attached hereto as Schedule 'A' and forming
part of this by-law.
2. That the Mayor and Chief Administrative Officer be authorized and directed
• to execute, on behalf of the Council of The Corporation of the Municipality
of Kincardine, the agreement with the Bruce County Library Board,
attached hereto as Schedule 'A'.
3. This by-law shall come into full force and effect upon its final passage.
4. This by-law may be cited as the "Bruce County Library Facilities and
Services Agreement (2017) By-law".

(the "Municipality")
Whereas, many of the Library facilities are in prominent locations in the municipalities; and, whereas,
the buildings and the Library service are a reflection of the municipalities, the improvement of the
Library facilities and the services provided shall be the responsibility of the local municipalities and
the Bruce County Public Library Board, respectively. The following policies are established to outline
the responsibilities of the parties involved in the provision of Library services.
A. Each Municipality which provides a library facility for County Public Library service
shall be responsible for:
1. Provide janitorial services for the interior of the building excluding the stacks;
2. Ensure a clean facility inside and outside that meets the present health, safety, and fire
regulations;
3. Ensure appropriate lawn and landscaping maintenance is maintained;
4. approved lighting for the provision of Library service, normally 70 foot-candles on reading
surfaces;
5. heating and cooling the Library to an adequate temperature, normally to 18 degrees C;
6. removal of garbage and recyclable materials with no requirement for bag tags;
7. snow and ice removal for all public spaces including walkways, parking lots;
8. insurance on the building or facility, including liability insurance;
9. repairs, renovations, and improvements to the library facility;
10.Utilities' costs.
B. The Bruce County Public Library Board shall be responsible for:
1. approval of all facilities for each Branch Library;
2. establishing the hours each Branch Library is open;
3. staffing the library;
4. a delivery system to all branches;
5. furnishings and equipment;
6. communication and networking capabilities; including conduits for IT requirements;
7. library materials and services;
8. insurance on the materials, furnishings and equipment, including liability insurance;
9. inspecting the branches periodically and reporting on the findings when necessary to both the
Library Board and the Municipality.

C. The Bruce County Public Library Board maintains operations within seventeen (17) branches
across all eight member municipalities. In an effort to ensure equity of rental charges and
fairness to all users of the services and systems the following rent will be provided for each
facility:
$ 7.32 sq/ft (internal square footage, excluding basements)
The annual rent shall increase 2% per annum between January 1, 2018 and December 31,
2033.
D. Any new facilities or major renovations or improvements to present facilities shall be jointly
planned between the Municipality and the Library Board. The Bruce County Public Library
Board shall consult with the local Municipality should renaming of a local Public Library be
under consideration. All concerns expressed by the local Municipality shall be taken into
consideration prior to a final decision. All parties shall mutually agree Dn the final naming.
E. To ensure clear communication and proper facility maintenance the following will be adhered
to:
The Library Branch Supervisor will communicate with the Parks & Recreation Manager and or
Director of Community Services Staff. If the community does not have a Parks and Recreation
Facilities Manager on staff, the Library Branch Supervisor will communicate with the Municipal
Chief Administrative Officer.
F. Disputes to the agreement will be directed to the Director of Library Services(CEO) and the
appropriate staff at the local municipality for final resolution.
G. Either the Municipality or the Library Board may terminate this Agreement upon (180) days
written notice. This contract shall commence January 1, 2018 and expire December 31, 2033.
A new rental agreement shall be defined by June 30, 2033.
