BY-LAW #/8 - 1981
"
A by~law to regulate the holding of public entertainment, parades,
festivals, motor vehicle Dr motorcycle races, within the Corporation of the
Township of Kincardine.

Whereas the Municipal Act enables Municipalities to regulate the
holding of public entertainment, parades and festivals;
And whereas the Council of The Corporation of the Township of Kincardine
deems it expedient to licenae and regulate such events;
Now therefore be it enacted as follows:
1.
Before any person, persona, corporations, organizations or associations
may hold or conduct a public entertainment, festival or parade within
the limits of the said Township of Kincardine, they shall obtain a
licence therefore, and comply with the provisions of thia by-law.
The fee for such licence shall be $100.00 and shall be paid to the
Township Treasurer and deposited in the Township General Account.
No licence shall be granted under this by-law until the applicant has
deposited with the Township Treasurer an amount as eatimated by the
Senior Officer of the Ontario Provincial Police Detachment having
jurisdiction in the Township: Such deposit to be the estimate adequate
cost of additional police protection during the period of entertainment
or festival or parade, or any Dr all of them, during which such police
protection shall in their opinion be necesasry.

No licence shall be granted under this by-law unless and until the
applicant has deposited with the Treasurer of the Township of Kincardine
a bond in the amount to be fixed by the Corporation of the Township
of Kincardine or until the Councilor the Corporation has dispensed
with the necessity of such bond being required. Such bond shall not
be required to exceed $200,000.00, and it shall contain a provision
indemnifying the Township against damage to public and private property
as well as indemnification for general property damage and public
liability.
No licence shall be granted under this by-law until and unless the
applicant has deposited with the Township Clerk a certificate in
writing frem the Bruce County Health Unit that all health and
asnitation requirements for the Public Entertainment, parade or
festival have been provided.
No licence shall be granted under this by-law until the applicant
has satisfied an official appointed by the Township of Kincardine,
that the property to be used is properly fenced and adeQUate on-site
parking is provided.

7. No licence shall be granted under this by-law until the applicant
has obtained a certificate from the Ministry of the Environment
that the day time noise level at the fence perimeter will not exceed
55 dba and the night time noise level will not exceed 50 dba.
8. Every person, asaociation Dr corporation who infringes any proviaions
of this by-law shall incur a penalty of not more than $2,000.00
excluding coata recoverable under the Provincial Offencea Act, all
the provisiona of which apply.
9. Thia by-law ahall not apply in the caae of any entertainment, festival
or parade which ia being sponsored or held in any Church presently
exiating in the Townahip, Dr any Municipally sponsored event, held in
any Municipally owned building. Further, the Council may in it's
diacretion dispense with any of the requirement a of this by-law.
