HomeMy WebLinkAboutBRU 85 002 amend industrial BEC THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 85-2 BEING A BY-LAW TO AMEND BY-LAW NO. 76-13, AS AMENDED, BEING THE RESTRICTED AREA BY- LAW FOR THE CORPORATION OF THE TOWNSHIP OF BRUCE. THE COUNCIL of the Corporation of the Township of Bruce, pursuant to Section 34 and 35 of The Planning Act, 1983, ENACTS as follows: 1. By-law No. 76-13, as amended, being the Restricted Area By-law for the Corporation of the Township of Bruce, is hereby further amended by inserting the following Zone and Symbol between the 'Restricted Industrial Extractive' (IE-R) zone and the 'Restricted Open Space' (OS-R) zone in the list of Zones and Symbols contained in Section 4.1 B) thereof: Energy Centre Industrial ECl 2. By-law No. 76-13, as amended, is hereby further amended by adding the following Section 13.1.3 thereto: 13.1.3 Energy Centre Industrial (ECl) (a) industrial and/or agricultural uses which: (i) utilize steam and/or other products or þy-products of the Bruce Nuclear Power Development and need to be located in close proximity to the Bruce Nuclear Power Development to utilize the products or by-products because of financial or physical factors; and/or (b) (ii) utilize the products or by-products of one or more uses identified in clause (i) above and need to be located in close proximity to one or more uses identified in clause (i) to utilize the said products or by-products; and/or (iii) produce products required by one or more uses identified in clause (i) above and need to be located in close proximity to one or more uses identified in clause (i) to allow their products to be properly or efficiently utilized. a service centre incorporating facilities to serve the needs of those uses identified in paragraph (a) above, such as the following: (i) administrative offices, (ii) limited commercial facilities with a maximum floor area of 929 square metres which directly serve the employees of those uses identified in paragraph (a), including a restaurant, convenience store or bank, and public uses. (iii ) r=e. ~ - 2 - ~ (c) accessory uses, buildings and structures. (d) for the purposes of paragraph (b){iii) above, the permitted "public uses" shall be limited to those uses for the purpose of public service by the Municipality and for the provision of local utility services. 3. By-law No. adding the 13.2.1 76-13, as amended is hereby further amended by following Section 13.2.1 thereto: (a) The following standards shall apply to the use of any land, building or structures within the Energy Centre Industrial (ECI) Zone: Minimum Lot Area 2 ha Minimum Lot Frontage 30 m Maximum Coverage 50 % Minimum Setbacks Front Yard 15 m Side Yard 6 m Rear Yard 10 m (b) Notwithstanding Section 13.3 below, the provisions of Subsection 8.6 to 8.6.2 inclusive shall not apply to the Energy Centre Industrial (ECI) Zone, in which the maximum total floor area for any accessory use(s) shall not exceed ten percent (lO%) of the total floor area of the principle use{s). (c) Notwithstanding the Minimum Yard Setbacks contained in paragraph (a) above, the minimum setback for all uses, buildings or structures adjacent to the Little Sauble River shall be as follows: o 10 20 30 Setback from Centre of River Bed 15 m 27 m 40 m 52 m Percent Slope 4. By-law No. 76-13, as amended, is hereby further amended by adding the following Section 13.4 thereto: 13.4 Those lands delineated as Energy Centre Industrial Holding Zone EC1-h on Schedule "A" to this By-law shall be used in compliance with the ECI Zone provisions contained in this By-law once the Holding symbol 'h' is removed. In the intermim, only those uses, buildings and structures existing at the date of passing of By-law 85-2 shall be permitted. PROVISIONS FOR ENERGY CENTRE INDUSTRIAL HOLDING ZONE - 3 - 5. Schedule "A" to By-law No. 76-13, as amended, is hereby further amended by changing thereon: a) from H-R to ECI-h, and b) from IE-R to ECI-h, and c) from A-R to ECI-h the zoning designations of those parts of Lots A, B, C, D and E, Concession 3 and Lots C, D, and E, Concession 4, in the Township of Bruce which are shown outlined in the heaviest black broken line on the attached Schedule "A". 6. This By-law takes effect from the date of passage by Council and comes into force pursuant to the provisions of The Planning Act, S.O. 1983.
