BEING a by-law to authorize the establishment of a committee to be known as "The
Bruce Economic Assessment, Planning and Development Committee II and to authorize
the entering into of an agreement to establish the said committee.
WHEREAS The Municipal Act R.S.O. 1980, Section 208 S.S. 22, authorizes the
Council of all municipalities to pass by-laws for the disseminating of information
respecting the advantages of the municipality as an industrial, agricultural,
business, residential or vacation centre.
AND WHEREAS the Minister of Employment and Immigration for Canada is authorized
under the Labour Mobility and Incentive Regulations to enter into agreements
with provinces, Employers and Workers in respect of labour mobility and assessment
incentives.
AND WHEREAS a Committee known as the Bruce Economic Assessment, Planning and
Development Committee has been formed under a memorandum of understanding and
is authorized to enter into such an agreement.
AND WHEREAS the Council of the Corporation of the Township of Bruce is desirous
of becoming part of the said Bruce Economic Assessment, Planning and Development
Committee:
NOW THEREFORE the Council of the Corporation of the Township of Bruce ENACTS
as follows:
1. That the Reeve and the Clerk be and they are hereby authorized to execute
on behalf of the Municipality a Memorandum of Understanding with:
The Bruce County
The Village of Paisley
The Town of Southampton
The Town of Port Elgin
The Town of Kincardine
The Village of Ripley
The Village of Tiverton
The Township of Bruce
The Township of Saugeen
The Township of Kincardine
The Township of Huron
Resolute Development Corporation
The United Association of Journeymen and Apprentices of the Plumbing and
Pipefitting Industry of the United States and Canada, Local 527
The Canadian Union of Public Employees

2. That three persons shall be appointed to the said Committee to represent
the Corporation of the Township of Bruce.
3. The said Committee members shall be appointed by resolution of Council
and;
- the Reeve and Deputy-Reeve representing Bruce Township Council,
- one Alternate ~ember shall be appointed from Council to replace the
Reeve or Deputy-Reeve in his absence~
4. That the said representatives shall be paid such out of pocket expenses
and mileage as they incur while attending regular meetings of the Committee
at the municipal rates that may be established from time to time.
5. That the Memorandum of Understanding attached hereto and marked as Schedule
"A" shall form part of this By-law~
6. That the Committee shall submit an annual Budget prior to February 15th
of each year with the municipal portion to be approved by a majority of
the participating Council by March 31st in each year based on the Formula
set out in Schedule nBn attached hereto~
7. That the initial establishing budget effective immediately shall be Twenty
Thousand Dollars ($20,000.00) based on the Formula in Schedule "B" of this
By-law.

(hereinafter referred to as "the Minister")
AND:
THE MINISTER OF LABOUR FOR ONTARIO
(hereinafter referred to as "the Provincial Minister")
AND:
THE MINISTER OF INDUSTRY AND TRADE FOR ONTARIO
(hereinafter referred to as "the Provincial Minister")
AND:
THE BRUCE ECONOMIC ASSESStlliNT, PLANNING
AND DEVELOPIŒNT COMrUTTEE
.
(hereinafter referred to as. "the Committee")
WH~REAS the Minister of Employment and Immigration is authorized
under the Labour Mobility and Assessment Incentives Regulations
to enter ir.to agreements with provinces, employers and workers
in respect of labour mobility and assessment incentives;
AND WHEREAS representatives of the Bruce County, the Village
of Paisley, the To~n of Southampton. the Town of Port Elgin,
the Tovm of Kincardine, the Village of Ripley, the Village
of Tiverton,the Township of Bruce, the Township of Saugeen.
the Township of Kinardine, the Township of Huron, the Resolute
Development Corporation, the United Association of Journeymen
and Apprentices of the Plumbing and Pipefitting Industry of the
United States and Canada, Local 527, and the Canadian Union
of Public Employees have established themselves as the Bruce
Economic Assessment, Planning and Development Committee;

AND WHEREAS the Provincial Ministers. in the exercise of that
office, are authorized to sign this Agreement;
NOW, THEREFORE, THIS AGREEMENT ~ITNESSETH that the parties
hereto, in consideration of the covenants and agreements
hereinafter contained, covenant and agree with each other
as follows I
1. The Memorandum of Understanding, dated
under which the Committee has been established, is
attached·hereto as Appendix "En and forms an integral
part of this Agreement.
2. The Committee, with the assistance of the Industrial
Adjustment Service, will select and appoint a
competent person to act as its Chairman. Such
appointment shall be made by instrument in writing
stating the duties, remuneration and tenure of the
Chairman.
J. The Committee will undertake a program of economic
assessment, planning and adjustment as provided in
Section 5 of the Memorandum of Understanding.
4.(a) A representative of the Industrial Adjustment
Service shall be notified in advance of all meetings
of the Committee and may attend any or all of such
meetings to advise and assist the Committee in the
perfor~Ance of its functions.
(b) A representative of the Provincial Ministers may
attend any or all meetings of the Committee to
advise and assist the Coœmittee in the performance
of its functions. If requested, the Chairman will
notify such representatives in advance of all
meetings.
5. The parties to the Memorandum of Understanding will
make available to the Committee information in
such detail as will permit a proper investigation
and analysis of the manpower problems including
detai1edskills inventory.
6. All person3 appointed to the Cownittee agree to
hold in strict confidence any information of a
confidential nature which is revealed to them as
a result of their appointment to the Committee.
7. Upon completion of the program the Committee will
forward a confidential copy of its report to the
Minister and the provincial Ministers together with
a statement of the actions it proposes to take as
a result of the recommendations in the said report.

8. Coincident with the date on which the Committee
submits its final renort and recommendations to
the parties, this Committee shall have no further
duties and responsibilities under the terms of
this Agreement~ and it shall thereafter cease
to exit.
9. The Committee will pay all shareable costs, as
set forth in Schedule "A" attached hereto, in
relation to the identification and assessment of
the manpower problems and the development of a
manpower adjustment program upon presentation
of vouchers or statements of account which have
been approved and submitted to it by the Chairman.
10. The cost of the program, in relation to the items
of expenditure set forth in Schedule "A", shall
be shared as follows I
40% by the Minister
2~ by the Minister of Labour for Ontario
10% by the County of Bruce
1% by the Village of Paisley
J% by the Town of Southampton
7% by the Town of Port Elgin
7% by the Town of Kincardine
1% by the Village of Ripley
1% by the Village of Tiverton
2% by the TO\Ynship of Bruce
2% by the Township of Sau.geen
J% by the Township of Kincardine
J% by the Township of Huron
ll.(a) The Minister will pay the Committee an assessment
incentive which shall be equal to forty percent
of the shareable costs paid by the Committee in
accordance with Section 9 of this Agreement, but
such incentive shall not exceed EIGHT THOUSAND
DOLLARS (:b8,OOO.00) or such greater ,amount as the
Minister may approve. No member of the House of
Commons shall be admitted to any share or part of
this Agreement or to any benefit to arise therefrom.
(b) The Provincial Minister of Labour will pay the
Committee an assessment incentive which shall be
equal to 20 percent of the shareable costs paid
by the Committee in accordance with Section 9,
but such incentive shall not exceed FOUR THOUSAND
DOLLARS (~D4,ooo.OO) or such greater amount as the
Provincial Minister of Labour may approve.

Subject to this Agreement, the assessment incentive
shall be due and payable, in full, thirty days
after the date the Minister receives the report
referred to in Section 7, but the Minister may,
on application therefor by the Committee, make
progress payments on account of the assessment
incentive to reimburse the Committee for shareable
disbursements made to the date the application is
made.
(b)
Subject to this Agreement, the assessment incentive
provided by the Provincial Minister of Labour
shall become due and payable, in full, thirty
days after the date the Provincial Minister of
Labour receives a copy of the report referred to
in Section 7, but the Provincial Minister of Labour
may, on application therefor by the Committee,
make progress payments on account of the assessment
incentive to reimburse the Committee for shareable
disbursements made to the date the application is
made. Such application by the Cow~ittee shall be
made through the Industrial Adjustment Service.
The Industrial Adjustment Service will advise the
Provincial Minister of Labour as to the correctness
of the application by the Committee.
The amount of the progress payment made in accordance
with Section l2(a) shall not exceed forty percent
of the shareable disbursements made by the Cow~ittee
for the period in respect of which it is paid.
(b)
The amount of the progress payment made in accordance
with Section l2(b) shall not exceed 20 percent 'of
the shareable disbursements made by the Committee
for the period in respect of which it is paid.
The Minister will not be required to make progress
payments totalling more than SIX THOUSAND FOUR
HUNDRED DOLLARS ($6,400.00) prior to receiving the
copy of the report referred to in Section 7.
(b)
The Provincial Minister of Labour will not be
required to m~{e progress payments totalling more
the THREE THOUSAND TWO HUNDRED DOLLARS ($3,200.00)
prier to receiving the copy of the report referred
to in Section 7.

Notwithstandine; Sections 11 and 12. no payment will
be made by the Minister on account of the assessment
incentive unless an application therefor is made
in such form as the Minister may prescribe and
accompanied by such other forms or documents as
the Minister may require.
The Committee will keep and make available to the
Minister and the Provincial Minister of Labour
such records as they deem necessary to substantiate
any claims for the payment of the assessment
, incentive and will allow free access to such records,
at convenient times, to all persons authorized
by law to keep or examine the records relating
to the accounts of the Canada Employment and
Immigration Commission or of the Ministry of
Labour for Ontario.
This Agreement shall remain in full force and
effect for a period of one year from the date first
above written and may be extended by mutual consent
of the parties should additional time be required
by them to fulfil its terms and conditions, or
it may be ~erminated on thirty days' notice at the
written request of any party.

SCHEDULE "A"
SHAREABLE COSTS
For the purpose of Section 9 of the Manpower Assessment Incentive
Agreement, the shareable costs are as follows:
1. The reg~~a~.~~,aight-time salaries, not exceeding
($ 75.00) per day, billed in multiples or
fractions thereof, of Committee members for the
time actually engaged in business of the Committee
as certified by the Chairperson.
2. Necessary disbursements for travelling (except
outside Canada), office supplies, clerical and
stenographic services, preparation and printing of
reports, and such other expenses as are approved
by the Manpower Power Consultatiave Service.

3. Salaries as follows, provided prior approval is
obtained from the Manpower Consultative Service:

(a) Remuneration of the Chairperson of the
Committee.
(b) Remuneration of. persons appointed by the
Committee to conduct investigations and to
assist in the development of the manpower
adjustment program.

MEMORANDUM OR UNDERSTANDING TO ESTABLISH
~HE BRUCE ECONOMIC ASSESS~ENT, PLANNING
AND DEVELOPMENT CO~ll~ITTEE
The undersigned parties, having recognized the importance of
the economic and social proble~s resulting from the drastic
decline in employment opportunities in the Bruce County and
immediate area, and the difficulties encountered in attempting
to expand and increase the industrial, commercial, tourism,
and institutional infrastructure, have decided to establish a
Committee to be known as:
THE BRUCE ECONOMIC ASSESS~ŒNT, PLANNING
AND DEVELOp~mNT COìU~ITTEE
(hereinafter referred to as the "the Committee")
With the following principles and understanding:
1. The parties sponsoring this Committee shall be:
"The Bruce County
The Village of Paisley
The Town of Southampton
The Town of Port Elgin
The To~~ of Kincardine
The Village of Ripley
The Village of Tiverton
The Township of Bruce
The Tovmship of Saugeen
The Tovmship of Kincardine
The Township of Huron
Resolute Development Corporation
The United Association of Journeymen and
Apprentices of the Plumbir.g ana Pipefitting
Industry of the United States and Canada.

The Canadian Union of Public Employees
The Committee may, at its discretion, accept additional
members and establish the financial and other conditions
under which they may be admitted.

The Committee will appoint two members, one of whom
shall be designated Treasurer, to act jointly as signing
officers for all transactions authorized by the Committee.
Nothing in this ~emorandum. nor in the stated objectives
or terms of reference of the Co~~ittee, is intended to
imply or suggest that the parties hereto have in any way

agreed that the Committee, or any sub-committee created
by it, or any function carried out under this Memorandum,
shall modify or affect the rights. obligations, and
responsibilities of the parties.
5. The terms of reference and objectives of the Committee
shall be:
(a) To assess the impact on the County as a result of
the forecast loss of approximately 3.500 jobs at
the Bruce Nuclear Project over the next two years.
(b) To examine and make recommendations on local
linkages to aid and support economic development
to create alternative jOb opportunities with a
view to maintaining the current infrastructure.
(c) To examine ways and means to advance the proposed
Bruce EnerBY Centre for industrial purposes.
(d) To recommend to their principals and appropriate
governmental authorities a' basic economic develop-
ment strategy, marketing philosophy and means
whereby the planning, development and management
of the industrial strategy of economic. development
may be enhanced.
(e) with the assistance of the Industrial Adjustment
Service the Minister of Labour for Ontario to
bring to bear and make the most effective use of
all public measures and services available from'
the federal and provincial governments.
Representatives of the Ministry of Industry and
Trade for Ontario have agreed to assist the
Committee in the pursuit of its objectives.
6. Representation:
(a) Each party hereto shall have the right to be represented
on the Committee by three persons and shall advise,
in writing, all other signatories to this Agreement
of the name of their respresentative.
(b) Each party hereto shall name an alternate to
replace the regular delegate, in the event he
has to resign or cannot attend, in the same
manner as specified in (a) above.
'(c) Decisions and recommendations of the Committee
shall be based on a consensus of those attending.
(d) The Committee may establish sub-co~~ittees to
further its objectives and establish the terms of
reference for such sub-committees.

Finances:
(a) The Committee will request an advance from the
participating Parties, the Minister of Employment
and Immigration and the Minister of Labour for
Ontario sufficient to allow it to pursue its
objectives.
(b) The Committee shall establish a bank account in
a chartered bank. All monies received by the
Committee shall be deposited in the said account
and all expenditures as approved by the Committee
shall be paid through it.
(c) Expenditures shall be limited to those items
listed in Schedule "A" of Assessment Incentive
Agreement.
(d) \'Ihen the work of the Committee is completed or
discontinued, any monies remaining in the bank
account of the Committee, after payment of all .
reasonable and legitimate expenses of the Committee,
shall be returned to the parties in the same
proportion as the original sums contributed by
the Parties.
8. The Committee will remain active at the pleasure of the
majority of the Parties and will disband immediately
on the written request of a majority of them.
9. The Committee shall ensure that any of the services it
offers to the public, including any brochures, pamphlets,
correspondence or advertisement, be provided in both
official languages of Canada when such service is addressed_
to the public in general o~ in the official language
chosen by the client, when the service is provided on
an individual basis.
10. In full understanding and agreement of the foregoing,
parties have hereto set their hand on the
