NO. 2016 -135
BEING A BY -LAW TO AUTHORIZE THE ACCEPTANCE OF CERTAIN DEEDS
OF LAND AND TO ASSUME AND DEDICATE THE SAID LANDS FOR ROAD
PURPOSES
WHEREAS Section 8(1) and 9 of the Municipal Act, 2001, S.O. 2001, c.25 as
amended, provide that the powers of a municipality under this or any other Act
shall be interpreted broadly so as to confer broad authority on the municipality to
• enable the municipality to govern its affairs as it considers appropriate and to
enhance the municipality's ability to respond to municipal issues and has the
capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under this or any other Act;
AND WHEREAS Section 51 (25c) of the Planning Act allows the municipality to
impose conditions to the giving of a consent;
AND WHEREAS The Corporation of the Municipality of Kincardine deems it
expedient to impose the condition that sufficient lands be deeded to the
Municipality, to be assumed and dedicated by the Municipality for road widening
purposes;
AND WHEREAS several parcels of land have been so deeded to the said
Municipality as a condition to a subdivision or development agreement,
condominium approval, or other municipal purposes;
AND WHEREAS it is necessary to change the ownership of the land from The
Corporation of the Township of Kincardine to The Corporation of the Municipality
• of Kincardine;
AND WHEREAS it is deemed expedient to accept these parcels of land and to
assume and dedicate them for road purposes;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. The lands described as Lorne Beach Road PIN 33294 -0385 (LT) Part Lot
50 Concession A Kincardine; Part Lot 51 Concession A Kincardine Part 1
and 2 3R -2776 and Part 1, 2, and 3 3R -2815, between shore road
allowance and County Road 23; Kincardine are accepted by The
Corporation of the Municipality of Kincardine.
2. That the said lands be and they are hereby assumed by The Corporation
of the Municipality of Kincardine.

3. The ownership of this land be changed from The Corporation of the
• Township of Kincardine to The Corporation of the Municipality of
Kincardine.
4. That the said lands be and they are hereby dedicated as part of the Road
System of The Corporation of the Municipality of Kincardine for the road
on which they are situate.
5. That the Mayor and Chief Administrative Officer be authorized and
directed to execute, on behalf of the Council of The Corporation of the
Municipality of Kincardine, documents to complete this transaction.
6. This By -law shall come into full force and effect upon its passage.
7. This by -law may be cited as the "Road Dedication (Lorne Beach Road
Between Lots 50 — 51, Concession A) By -law ".
