BEING A BY -LAW TO AMEND BY -LAW NO. 2016 -065; BEING A BY -LAW TO
AUTHORIZE THE SIGNING OF A LEASE AGREEMENT WITH MATRIX
NORTH AMERICAN CONSTRUCTION LTD. FOR RENTAL SPACE IN THE
MUNICIPAL ADMINISTRATION CENTRE
WHEREAS Section 8 (1) and 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as
• amended, provide that the powers of a municipality under this or any other Act
shall be interpreted broadly so as to confer broad authority on the municipality to
enable the municipality to govern its affairs as it considers appropriate and to
enhance the municipality's ability to respond to municipal issues and has the
capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under this or any other Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine,
with the passage of By -law No. 2016 -065, Matrix North American Construction,
Ltd. Lease Agreement (2016) By -law, entered into a lease agreement with Matrix
North America Construction Ltd. for rental space at the Municipal Administration
Centre;
AND WHEREAS Matrix North American Construction Ltd. has requested to
amend By -law No. 2016 -065 to increase the rental space by 208.5 sq /ft for a total
of 619.25 sq /ft;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it advisable to enter into an amendment to the lease agreement with
• Matrix North American Construction Ltd.;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That The Corporation of the Municipality of Kincardine enter into an
amendment to the lease agreement with Matrix North American
Construction, Ltd., for the rental of commercial office space at the
Municipal Administration Centre, 1475 Concession 5, Municipality of
Kincardine in consideration of rents, covenants and obligations.
2. That the Mayor and Chief Administrative Officer be authorized and
directed to execute, on behalf of The Corporation of the Municipality of
Kincardine, the amendment to the Lease Agreement with Matrix North
American Construction, Ltd., attached to this by -law as Schedule 'A'.
3. That this by -law shall come into full force and effect upon its final passage.

This ADDENDUM made THIS 1 day of D ce€(2016 of Cyr � 201 b
IN PURSUANCE OF THE SHORT FORMS OF LEASES ACT.
BETWEEN: THE CORPORTION OF THE MUNICIPALITY OF KINCARDINE
(hereinafter called the "Landlord ") OF THE FIRST PART
- and —
MATRIX NORTH AMERICAN CONSTRUCTION, LTD.
(hereinafter called the "Tenant ") OF THE SECOND PART
WHEREAS the Council of the Corporation of the Municipality of Kincardine, with the passage of
By -Law No. 2016 -065, signed a lease agreement with Matrix North America Construction Ltd. for
rental space in the Municipal Administrative Office;
AND WHEREAS the Tenant has requested to increase the rental space by 208.5 sq /ft for a total of
619.25 sq /ft.
AND WHEREAS both parties agree to the increase.
NOW THEREFORE THIS ADDENDUM WITNESSETH THAT the parties hereto agree as follows:
1. That Section 2 (b) be removed and replaced with the following:
(Renewal rate = $14.95 per square foot x 619.25 square feet)
The tenant covenants to pay the Landlord, during the Term of this Lease monthly rent installments of
SEVEN HUNDRED, SEVENTY ONE DOLLARS AND FOURTY EIGHT CENTS ( *$771.48)
plus HST, each in advance on the 1' day of each and every month and the last such payment to be
made on the 1S day of the month the Lease is to be terminated.
*If lease is extended beyond June 1S 2017 the above noted rent shall increase by the CPI.
2. THAT Schedule `A' be removed and replaced with Schedule `A' as attached to this addendum.
IN WITNESS WHEREOF the Landlord and the Tenant have executed this Lease.
