HomeMy WebLinkAbout16 110 Delegation of Powers and Duties letter of non-objection required for a temporary liquor licence extension THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE 11111 „k, ''itsOmALItt OF K1Np� BY -LAW NO. 2016 -110 BEING A BY -LAW TO DELEGATE CERTAIN POWERS AND DUTIES WHEREAS Section 270 (1) of the Municipal Act 2001, S.O. 2001, c. 25, as amended, requires a municipality to adopt and maintain a policy with respect to the delegation of its powers and duties; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine • adopted a Delegation of Powers and Duties Policy GG 3.7 by By -law No. 2007- 355 on November 21, 2007; AND WHEREAS Council deems it appropriate to delegate certain powers and duties to staff; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the power to approve and issue a letter of non - objection required for a Temporary Liquor Licence Extension be delegated to the Clerk as set out in Schedule "A ", attached hereto and forming part of the By -law. 2. That this By -law shall come into full force and effect upon its final passage. 3. That By -law may be cited as the "Delegation of Powers and Duties (Letter of non - objection required for a Temporary Liquor Licence Extension) By -law ". READ a FIRST and SECOND TIME this 5th day of October, 2016. • READ a THIRD TIME and FINALLY PASSED this 5th day of October, 2016. - $ a. is _ 4■41 _ Mayor Deputy Clerk • Schedule "A" Delegation of Powers and Duties (Letter of No- Objection required for a Temporary Liquor Licence Extension) By -law By -law No. 2016 - 110 111 Consent to Letters of No- Objection required for a Temporary Liquor Licence Extension The Alcohol and Gaming Commission of Ontario (AGCO) has the authority to grant a temporary physical extension of the premises to which a licence to sell liquor applies for a period of 14 days or less if the extension is adjacent to the premises to which the licence applies. As part of this process, applicants must obtain a letter of non - objection from the Municipal Clerk. The exercise of this delegated power is subject to the provisions /requirements of the Delegation of Powers and Duties Policy GG.3.7. This is a power that if carried out by staff will provide a more streamlined, efficient process. Process for Consent to Letters of No- Objection required for a Temporary Liquor Licence Extension 1. The Clerk would receive a letter of notification and sketch or plan of the prosed extended licensed area from the applicant. • 2. The Clerk will provide a letter of non - objection subject to: • That the applicant notify local residents of the event by posting on the property, their website, local newspaper or other method approved by the Clerk and provide a contact name and number for any complaints regarding noise; • That an appropriate level of security be provided as may be required by the Ontario Provincial Police; • That any other permits as may be necessary be obtained by the Municipality of Kincardine (i.e. Building Permits, Fire Department Permits, etc.); • That any Alcohol and Gaming Authority of Ontario requirements be fulfilled. 3. A report of the letters of non - objection provided will be placed on the Consent Agenda for Council's information. 4. Regardless of any authority delegated to the Clerk under this By -law, Council • may, after notifying the Clerk, exercise any authority that is delegated by them. •
