HomeMy WebLinkAboutBRU 88 035 rec program THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 88-35 BEING A BY-LAW to authorize the carrying on of a Communi tv Proaram of Recreation. within the meaning of the regulation under the Ministry of Tourism and Recreation Act 1982, and the regulations made thereunder. 1. The Council of the Corporation of the Municipality of the Township of Bruce enact as follows: (a) Pursuant to the regulations made under the Ministry of Tourism and Recreation Act 1982, a Community Program of Recreation is hereby established for the residents of the municipality. (b) The said Community Program of Recreation shall be directed, managed and controlled on behalf of the Council of the Corporation by a committee known as the Municipality of Bruce Township Recreation Committee. 2. The Committee shall be appointed from time to time by the Council of the Corporation as follows: (a) Five members of the Council of the Municipality of the Township of Bruce. 3. ADMINISTRATION (a) In carrying out the provision of this By-law the Committee shall, at all times be the agent of the Municipality of Bruce Township and while acting bona fide within the limits of the authority of this by-law, neither the Committee nor any member thereof, shall incur any liability by reason of anything done or left undone by the Committee; provided, however, that nothing in the paragraph contained shall authorize or empower the Committee to incur any debt, liability or obligation for which the municipality of the Township of Bruce shall become liable, without having previously obtained the consent of the Council. (b) The Committee shall be responsible for all policies, rulings, and regulations relating to the administration of the Community Program of Recreation and rules and regulations pertaining to the proper conduct of such Community Programs of Recreation subject to the approval of Council. THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 88-35 PAGE 2 (c) The Committee shall meet monthly on a date to be set by the Committee. (d) The Committee shall provide annual reports and minutes of monthly meetings to Council for its approval. (e) The term of office of the members of the Committee shall be determined annually by resolution or by-law of the Municipal CounciL 4 . PERSONNEL (a) The Committee may recommend to the Municipal Council the appointment of a properly trained and qualified Municipal Recreation Director. Such Municipal Recreation Director shall be employed full time and shall be directly responsible to the Council through the Committee. (b) The Committee may appoint recreation workers, either part time or full time, and shall be responsible for assigning the duties and responsibilities of such employees. Where a Municipal Recreation Director is employed, such appointments should be subject to their recommendation. 5. FINANCIAL (a) Annually, by March 31st, the Committee shall submit and interpret to the Council a bUdget for its approval, and shall make to the Council full and complete annual and other reports as required. (b) The Committee shall not have its own bank account. All de pas its and payments will be made through the Municipal Treasurer as regulated by the Municipal Act. (c) The Committee may solicit or receive on behalf of the municipality any gifts or bequests of money or services or any donations to be applied, principal or income, for either the temporary or permanent use for facilities, equipment, program or other recreational purposes. PROGRAM AND PLANNING (a) The Committee shall encourage, assist, and where necessary, conduct the programs of recreation which will meet the needs and interests of the inhabitants of the Municipality of the Township of Bruce. Such programs shall include the social, cultural and physical aspects of recreation as applied to each age group, both male and female. (b) The Committee shall assist in the co-ordination of community recreation activities. (c) The Committee shall assist, encourage and provide advisory services on request to all groups, organizations or persons carrying on recreation activities in the Municipality of the Township of Bruce. (d) The Committee shall at all times keep the inhabitants of the Municipality of the Township of Bruce aware of the recreation opportunities which are available and will continually interpret to the public the total community program of recreation. (e) The Corporation of the Township of Bruce, through the Committee shall have the primary responsibility for assisting, stimulating and initiating the provision of community recreation programs and services. 7. FACILITY MANAGEMENT (a) The said Committee shall operate, maintain and manage on behalf of the said Corporation all properties which are now or which may hereafter be established as community centres, exce pt Brucedale Community Centre and Bruce Township Community Centre, pursuant to the Community Recreation Centre Act, or the regulations made thereunder. This by-law goes into effect forthwith on the passing thereof and By-law No. 78-8 is hereby repealed and rescinded.
