HomeMy WebLinkAbout16 092 2016 Consolidated Rates & Fees Amendment (1) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT A , 70 /PALIiY OF:∎11 BY -LAW NO. 2016 - 092 BEING A BY -LAW TO AMEND BY -LAW NO. 2015 -148; BEING A BYLAW TO ESTABLISH RATES AND FEES FOR SERVICES PERFORMED BY THE MUNICIPALITY OF KINCARDINE WHEREAS Section 8 (1) and 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that the powers of a municipality under this or any other Act • shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS Section 391 (1) of the said Municipal Act, 2001 authorizes a municipality to impose fees or charges on persons, for services or activities provided or done by or on behalf of it; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine, with the passage of By -Law No. 2015 -148, established rates and fees for services performed by the Municipality; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it necessary to amend Schedule `D' of By -law No. 2015 -148 to amend the interment fees (and removes the licence fee), Schedule `L' to amend the Development Charges as per By -law No. 2016 -080 and Schedule `O' amends the fire response fee as per the MTO; • NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That Schedule `D', Schedule `L' and Schedule `O' of the Municipality of Kincardine 2016 Consolidated Rates and Fees By -law No. 2015 -148 is hereby repealed and replaced with the attached Schedule `D', Schedule `L' and Schedule `O'. 2. That Schedule `L' (Development Charges) be effective July 13, 2016 and Schedule `D' and `O' be effective upon the final passage of this by -law. 3. That this by -law shall come into full force and effect upon its final passage. 4. That this By -law may be cited as the "2016 Consolidated Rates & Fees Amendment (1) By -law ". DEVELOPMENT AND CAPITAL CHARGES CONT'D 2016 Fee Applicable Taxes For any subdivision agreements entered into prior to July 13, 2011, capital charges are as follows: 2 Sanitary Sewer Capital Charges The charges referenced in (a) and (c) below will not apply in the case of a residential infill lot where a capital fee had previously been paid by means of old impost fees, frontage fees or where old existing documentation proves previous payment. a.
