HomeMy WebLinkAboutBRU 90 022 Repealed by No 94 13 Lcd ., if 'Ii-! / F0/1 '1'HE CORPORA'1'IOR OF '1'HE '1'OWlfSHIP OF BRUCE BY-LAW RO. 90-22 BEING A BY-LAW '1'0 AMEND BY-LAW RO. 88-11, BEING THE BUILDING BY- LAW OF THE TOWNSHIP OF BRUCE. WHEREAS the Corporation of the Township of Bruce did enact By-law No. 88-11 pursuant to the provisions of the Building Code Act, R.S.O., 1980, Chapter 51. AND WHEREAS it is now desirous and necessary to amend By-law No. 88-11. NOW THEREFORE the Council of the Township of Bruce enacts as follows: 1. Section 3 of By-law No. 88-11 is amended by adding the following Section 3.8 thereto. Section 3.8 In addition to the classes of permits set out in Schedule "A" to this by-law, all construction of any public building within the Township of Bruce shall be as set out in Schedule "C" to this by-law. 2. Section 6 of By-law No. 88-11 is further amended by adding "and Schedule "c" "immediately behind, "A" in the second line thereof. 3. By-law No. 88-11 is further amended by adding as SChedule "C" thereto, the schedule marked as Schedule "c" to this by- law. 4. Schedule "A" to By-law No. 88-11 is repealed and replaced with the Schedule marked as Schedule "A" to this by-law. 5. This by-law comes into force on the day it is finally passed. 6. By-law No. 88-11 is further amended by adding the following Section 6.1 thereto. Section 6.1 The Chief Official shall place a valuation on the cost of the work, and if the permit applicant or holder disagrees with this valuation, the prescribed fee shall be paid before the issue of the permit. Upon completion of the work, if the actual cost of the work was less than the valuation placed by the Chief Official, an audited statement . ~. \ THE CORPORATION OF THE TOWNSHIP OF BRUCE BY-LAW NO. 90-22 PAGE 2 may be submitted detai ling the cost of all the component parts of the work. The Chief Official shall if the statement contains the cost of all component parts of the work upon which the valuation was required to be based, value the work in accordance with this statement and issue the appropriate refund. (a) (i) $7.00 for every $2,000,000.00; or $1,000.00 of cost up to (b) $5.00 for every $1,000.00 of cost from $2,000,000.00 to $10,000,000.00. (c) $4.00 for every $1,000.00 of cost over $10,000,000.00. .~ ~-- ~ MEMORANDUM OF UNDERSTANDING BET WEE N: THE CORPORATION OF THE TOWNSHIP OF BRUCE (Hereinafter called "Bruce") and - ONT AR IO HYDRO (Hereinafter called "Hydro") WHEREAS pursuant to By-law No. 88-11 as amended by By-law No. 90- 22 Bruce did establish fees for building permits. AND WHEREAS Hydro is a major builder in Bruce. AND WHEREAS it is desirable to establish terms and conditions for an efficient collection of building permit fees owed by Hydro. The parties hereto agree as follows: 1. Notwithstanding the provisions of Bruce By-law No. 88-11 as amended by By-law No. 90-22 Hydro and Bruce agree that the terms of this agreement shall be used as additional guidelines for the interpretation of the said by-laws and the payment of fees by Hydro to Bruce for building permits. 2. All Ontario Hydro related building, in Bruce, of a cost under $5,000.00 shall not require a permit or need be reported to the Township of Bruce, and Ontario Hydro agrees to pay an annual fee of $2,000.00 to cover all such permits. All Ontario Hydro related building of a cost between $5,000.00 and $20,000.00 constructed Qrr the Bruce Nuclear Power Development site must be reported to Bruce monthly on the form attached as a schedule to this agreement, together with the fee based on the cost of such construction in accordance with the "Public Buildings" fee schedule of the said by-law and no permit or inspection shall be required. 4. All Ontario Hydro related building of a cost over $20,000.00 constructed Qrr the Bruce Nuclear Power Development site, shall require permits and inspections and be subject to all of the requirements of the said by-law including the fee schedule established for "Public Buildings". 5. All Ontario Hydro related buildings constructed off the Bruce Nuclear Power Development site will be treated as general buildings in the Township and will be subject to the requirements of the said by-laws and shall pay the fees established in Schedule "A" to By-law No. 88-11 as amended by By-law No. 90-22. 6. (a) It is agreed that Building Permit costs for Ontario Hydro related buildings are not to be applied to any systems installed by Ontario Hydro, used for the production of energy but only to buildings and structures as defined in the Building Code Act, R.S.O. 1980, Chapter 51, Section l(b). (b) Any question of interpretation of what constitutes a "system" as opposed to a "building" shall be referred to the Bruce Township, Ontario Hydro Liaison Committee for final determination. ~-~-, ,~þ - 3 - 7.
