BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003 -25,
BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE
MUNICIPALITY OF KINCARDINE

Part Lots 51 -55, Lake Range, geographic Township of Bruce,
Municipality of Kincardine
• WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the
Councils of Municipalities to enact and amend zoning by -laws which comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has
enacted By -law No. 2003 -25, a zoning by -law enacted under Section 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires
to amend By -law No. 2003 -25;
NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine
ENACTS as follows:
1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by
changing thereon from `Residential One Special (R1 -p)', `General Agriculture
(A1)' and `Environmental Protection (EP)' zones to `Residential One (R1)',
`Residential One Special (R1 -bf)', `Residential One Special (R1 -bg)', `General
Agriculture Special Holding (A1- gg -H)', and `Environmental Protection Special
• (EP -u)' zones the zoning designation on those lands described as Part Lots 51-
55, Lake Range, geographic Township of Bruce, Municipality of Kincardine, as
outlined on the attached Schedule 'A'.By -law No. 2003 -25, as amended, being
the Comprehensive Zoning By -law for the Municipality of Kincardine, is further
amended by amending the following paragraph, as follows:
12.3.57 Notwithstanding their `R1' zoning designation, those lands delineated as
`R1 -bf' on Schedule `A' to this By -law may be used for `Residential One
(R1)' purposes in compliance with the `R1' zone provisions contained in
this By -law, excepting however, that:
i. The maximum lot area be no greater than 0.48 hectares;
ii. Site disturbance of any sort shall not exceed 0.4 hectares of land on
this lot. This notwithstanding, site alteration limited to established
best practices for forest management may be permitted beyond the
0.4 hectare disturbed area.
2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for
the Municipality of Kincardine, is further amended by amending the following
• paragraph, as follows:

12.3.58 Notwithstanding their `R1' zoning designation, those lands delineated as
• `R1 -bg' on Schedule `A' to this By -law may be used for `Residential One
(R1)' purposes in compliance with the `R1' zone provisions contained in
this By -law, excepting however, that:
i. The maximum lot area be no greater than 1.42 hectares;
ii. Site disturbance of any sort shall not exceed 0.4 hectares of land on
this lot. This notwithstanding, site alteration limited to established
best practices for forest management may be permitted beyond the
0.4 hectare disturbed area.
iii. For the purposes of this By -law, `Home Occupation — Household and
Domestic Arts' shall include `woodworking'.
3. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for
the Municipality of Kincardine, is further amended by amending the following
paragraph, as follows:
9.5.187 Notwithstanding their 'Al' zoning designation, those lands delineated as
`A1 -gg -H' on Schedule `A' to this By -law may be used for `General
Agriculture (Al)' purposes in compliance with the 'Al' zone provisions
• contained in this By -law, excepting however, that:
i. The minimum lot area be no less than 106.3 hectares;
ii. Site alteration shall be limited to established best practices for forest
management;
iii. The `H — holding' provision may be removed once the following
condition has been satisfied:
i. An engineering report pertaining to Floodplain Analysis has
been reviewed by the Municipality, County and Saugeen Valley
Conservation Authority, and approved by the appropriate
approval authority. An implementing Zoning By -law Amendment
shall effect the recommendations of such Floodplain Analysis
and the Environmental Impact Study (Natural Heritage
Environmental Impact Study, AWS, February 2015), to the
satisfaction of the appropriate Approval Authority.
4. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for
the Municipality of Kincardine, is further amended by amending the following
paragraph, as follows:
• their `EP' zoning designation, 34.6.20 Notwithstanding t g g , those lands delineated as
'EP-u' on Schedule `A' to this By -law may be used for `Environmental
Protection (EP)' purposes in compliance with the `EP' zone provisions
contained in this By -law, excepting however, that:
i. Site alteration shall be limited to established best practices for forest
management.
5. This By -law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.
6. This By -law may be cited as the "Amendment to Comprehensive Zoning By -law
2003 -25, (Part Lots 51 -55, Lake Range, geographic Township of Bruce,
Municipality of Kincardine), By -law ".
