BY-LAN NO. 92-18
BEING A BY-LAW to set the price for and authorize the sale of part
of Mary Street, Plan 114, Township of Bruce, County of Bruce
described as Part 2 on Reference Plan 3R-5602.
WHEREAS the Township of Bruce has applied to the ontario Court
(General Division) for an order closing to public travel that part
of Mary Street, Registered Plan 114, Township of Bruce described as
Part 2, 3R-5602.
AND WHEREAS the adjoining owners of almost all of the lands to the
east and west of the said part of Mary Street has applied to the
Township of Bruce to close the street and convey it to him.
AND WHEREAS the owner of the balance of the land adjoining the said
street has consented to the closing of the street and has
acknowledged he does not wish to acquire any part of the said
street.
AND WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, section
315 provides that when part of a highway is closed under the
Registry Act and the Council of a municipality determines to sell
the land forming the closed highway it shall set the sale price by
by-law and shall offer to sell it first to the owners of the land
abutting the closed highway.
NOW THEREPORE be it enacted by the Council of the Township of Bruce
as follows:
1. The sale price of that part of Mary street, Plan 114, Bruce
Township, described as Part 2 on Reference Plan 3R-5602 shall
be set at $1. 00.
2. The said part of Mary street shall be offered for sale to
James A. Sieffert and shall be subject to the reservation of
an easement for municipal and hydro services, if required.

In addition to the said sum of $1.00 James A. Sieffert shall
convey at no cost to the Township of Bruce, all of Lot 17,
Registered Plan 114, free and clear of all encumbrances.
4. James A. sieffert shall further pay all costs incurred by the
Township of Bruce in closing and conveying the said part of
Mary street and Lot 17, Plan 114.

5. The transaction shall be completed within 45 days of the final
passing of this by-law by the Council of the Township of
Bruce.
6. No deeds shall be delivered to James A. sieffert until all
costs have been paid to the Township of Bruce.
7. The Clerk and Reeve of the Township of Bruce are authorized to
sign the deeds and other documents required to complete the
sale and affix the seal of the Corporation as and when
required.
