HomeMy WebLinkAbout16 025 719 and 725 baird street (smith) deeming by-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT , ♦ ��• ���L�ALIiV OF BINCP� BY -LAW No. 2016 - 025 BEING A BY -LAW DESIGNATING CERTAIN LANDS WITHIN THE MUNICIPALITY OF KINCARDINE, NOT TO BE A REGISTERED PLAN OF SUBDIVISION Mark Andrew Smith and Karen Jane Smith PCL 80 -1 SEC M33, LT 80 PL M33; PCL 81 -1 SEC M33, LT 81 PL M33 Municipality of Kincardine (geographic Town of Kincardine) • WHEREAS Section 50(4) of the Planning Act, R.S.O. 1990 authorizes the Council of a Municipality to pass a by -law designating any Plan of Subdivision, or part thereof, that has been registered for eight years or more, not to be a registered Plan of Subdivision for the purposes of Subsection (3) of the Planning Act; AND WHEREAS certain lots described on Plan M33 are within the geographic Town of Kincardine, Municipality of Kincardine; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Registered Plan of Subdivision or parts thereof described in Paragraph 2 of this by -law is hereby designated to be a Plan of Subdivision, which shall be deemed not to be a Registered Plan of Subdivision for the purposes of Subsection (3) of Section 50 of the Planning Act, R.S.O. 1990. 2. That the lands subject to this By -Law are described as PCL 80 -1 SEC M33, LT 80 PL M33; PCL 81 -1 SEC M33, LT 81 PL M33 in the geographic Town of • Kincardine, in the Municipality of Kincardine. 3. That the Clerk of the Municipality of Kincardine shall cause a certified copy of this By -Law to be lodged with the County of Bruce and to be registered in the Land Registry Office for the County of Bruce as required by the said Planning Act, Sections 50 (26) and (28). 4. That notice of the passing of this by -law shall be given within 30 days of the passing thereof as required by the said Planning Act, Section 50 (29). 5. That the Council of the Municipality of Kincardine shall hear in person or by agent any person to whom a notice was sent and who within 20 days of the mailing of the notice applies to be heard, respecting the Amendment or repeal of this By -Law. 6. That this By -law may be cited as the "719 and 725 Baird Street (Smith) Deeming By -law" • READ a FIRST, SECOND TIME this 17th day of February, 2016 17th February, a THIRD TIME and FINALLY PASSED this 17 day of Feb nary, 2016 Mayor Dep ty Clerk
