HomeMy WebLinkAbout16 021 Delegation of Powers and Duties (Temporary Road Closures for Special Events) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT ji , 70 91: OF KINC O BY -LAW NO. 2016 - 021 BEING A BY -LAW TO DELEGATE CERTAIN POWERS AND DUTIES (Temporary Road Closures for Special Events) WHEREAS Section 270 (1) of the Municipal Act 2001, S.O. 2001, c. 25, as amended, requires a municipality to adopt and maintain a policy with respect to the delegation of its powers and duties; • AND WHEREAS the Council of the Corporation of the Municipality of Kincardine adopted a Delegation of Powers and Duties Policy GG 3.7 by By -law 2007 -355 on November 21, 2007; AND WHEREAS Council deems it appropriate to delegate certain powers and duties to staff; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the approval of Temporary Road Closures for Special Events be delegated to the Director of Public Works or authorized employee representing the Director of Public Works, as set out in Schedule "A ", attached hereto and forming part of the By -law. 2. That this By -law shall come into full force and effect upon its final passage. 3. That By -law may be cited as the "Delegation of Powers and Duties (Temporary Road Closures for Special Events) By -law ". READ a FIRST and SECOND TIME this 10 day of February, 2016. S FINA PASSED this 10th day of February, a THIR TIME and SS t y ry, 2016 Mayor Clerk • Schedule "A" Delegation of Powers (Temporary Road Closures for Special Events) By -law By -law No. 2016 - 021 • Approval of Temporary Road Closures for Special Events Pursuant to Policy TP 1.3 Temporary Road Closures for Special Events, special event organizers may apply to the Municipality for the temporary closure of municipal roadways for special events such as parades, street markets, and car shows. The Policy sets out that applicants requesting a road closure must fill out a "Special Event Application" as per PD.5.2 — Special Event Policy. When reviewing the road closure the following items will be taken into account. a. Potential adverse effects on public health and safety; b. Potential traffic impacts; c. Potential complications concerning construction projects; d. Lack of adequate detour routes; e. Concerns for the security of persons or property close to the proposed route; f. Whether the past or present conduct of the applicant or organization • sponsoring or conducting the special event affords reasonable grounds to believe that the event may not be carried in a lawful and controlled manner. The exercise of this delegated power is subject to the provisions /requirements of the Delegation of Powers and Duties Policy GG.3.7. This is a power that if carried out by staff will provide a more streamlined, efficient process. Conditions /Process for Approval of Temporary Road Closures for Special Events 1. The Temporary Road Closure falls within the guidelines set out in Policy TP 1.3 Temporary Road Closures for Special Events. 2. The Director of Public Works shall provide a report for the Consent Agenda that will include the event, the affected section of road, and the date and time of the closure. • 110
